SnCTION 1.
Ordinance
That from and after the passage, approval and publication of this
Ordinance, it shall he the duty of all persons, firms, companies or corpo-
rations, desiring or contemplating the opening, breakinn or excavating in
any street, sidewalk, alley, wharf or other. ptblic '.•rap of the City of
Paducah. Kentucky, for any purpose whatsoever, to file a -mitten applica-
tion with the Commissioner of Public Works, or any agent authorized by laws;
of the City of PaduckhgnKentucky, stating in general terms the character

of such opening, breaking; or excavation so contemplated, and giving the
width, length and depth, together with the location thereof, and the time
that will be required to complete same, and the purpose for which same
shall be made.
SECTION 2.

Before a permit is issued to any person, firm, company or corpora-
tion, permitting them to open or excavate in any of said streets, side-
walks, alleys, wharves or other public ways in the City of Paducah, Ken-
tucky, they shall agree, in writing, with the City of Paducah, Kentucky,
that said City shall replace, back -fill or reconstruct such opening so
made by said person, firm, company or corporation, and the replacing,
back -filling or reconstruction of said opening shall be made by the City
of Paducah, Kentucky, or its agents, and no other person; and said re-
placing, back -filling or reconstruction shall be done entirely at the
expense of the person, firm, company or corporation so securing said
permit for said opening or excavation, and the City of Paducah shall
determine the material and kind of work to be used for the purpose of re-
placing, back -filling or reconstruction of said opening or excavation.
SECTION 3.
Before a permit shall be issued to any person, firm, company or
corporation to mare any such opening or excavation, there shall be exe-
cuted to the City of Paducah, Kentucky, a Surety Bond to cover the cost of;
any and all liability that might be sustained on accoart of said opening
or excavation, and said person, firm, company or corporation, together
with its surety, shall be liable and responsible for any and all damages
sustained on account of said opening or excavation until the same has been,
turned over to the City of Paducah, Kentucky, for filling or replacement,
but the City of Paducah shall not be responsible, in any manner, on ac-
count of said opening or excavation, until such person, firm, company or
corporation, making the opening, breaking or excavation, shall rove to
the City of Paducah written notice that same is ready for filling or re-
placement; and said Imrson, firm, company or corporation shall also
deposit with the Commissioner of Public Finance, or the authorized anent
of the City of Paducah, Kentucky, a sufficient amount of money to be used
in defraying the expenses and cost of replacement, said amount to be

more money than is necessary to pay for said replacement, then the bal-
ance shall be returned to said person, firm, company or corporation; or
any person, firm, company or corporation may execute a bond, with Food ;I
surety, in lieu of the cash deposit above referred to, for the purpose of
securing the expense and cost of replaeinn said opening or excavation,
the amount of said bond to be determined by the Commissioner of Public
17 .Yorks, or the authorized agent of the City of Paducah, Kentucky, and
said bond to be approved by the Nayor; and, in the event the money so
deposited is not sufficient to defray said expenses, then the surety
bond so executed by the person, firm, company or corporation, as set -
out herein, shall be responsible and liable for the difference in the
amount deposited and the cost of replacement, and said Surety Bond shall I'
be executed to comply with the terms of this Ordinance.
SECT I01'. 4.
Any person, firm, company or corporation making any excavation,
or any opening whatsoever, in any street, sidewalk, alley, wharf, or
other public way, in the City of Paducah, Kentucky, without first com-
plyino- with all the terms of this Ordinance, shall be fined not less
than Five (05.00) Dollars, nor more than Fifty (,)50.00) Dollars for each
offense.
SECTION 5.
T, All ordinances, or parts of ordinances in conflict with this
wdinance, are,ofs-the extent of such c)nfl.ict, hereby repealed.

SECTION 6.
This Ordinance shall take effect and be in force from and after
its passage, record and publication.
