KENTUCKY, AND DEFINING HIS DUTIES idlD SjLARY.
Be it ordained by the Board of Commissioners of the City.
of Paducah, Kentucky:
Sec. 1. That the Board of Commissioners of the City
of Paducah, Kentucky, shall be, and they are hereby empowered to
employ an Inspector of weights and measures for the City of Paducah.
Sec. 2. Said Inspector of weights .a'id measures shall
be paid a salary of Seventy-five (ti'y75.00) Dollars per month for his
services by the City of Paducz_h and shall be subject to removal at
any time by thq Board of Commissioners with or without cause.
Sec. 3. That it shall be the duty of said weights and
measures Inspector to test, at least once a year, all weights,
measures, balances and sc.,:les, steel yards or beams in the City of
Paducah orned or used by any person, firm, company or corporation
enga=ged in buying or selling merchandise, groceries, produce, poultry,
grain, provender, meats, coal, ice, feed stuffs, iron, rags, metal,
junk, wares, wool, hides, leather or any other article of trade or
commerce. He shall also test all public scales where any commodities
or live stock are weighea and for which fees are charged.
Sec. 4. Said inspector, after making any of the tests
provided for herein shall deliver to the owner or operator of said
scales, weights, measures and balances so tested a certificate setting
forth the article so tested and result and date of the test amd said
inspector shall keep a complete record of all tests made by him and
on the first is=onday in each month shall file in the office of the
Commissioner of Public Finance s statement, over his signature, showing
the tests made by him, if.any, during the previous month to-gether
with the result thereof.
Sec. 5. Upon complaint of any person, made by affidavit,
before the Board of Commissioners of the City of Paducah, stating that
he has been cheated by the use of any so,,)les, balances or measures
within thirty days previous to said complaint, the Board of Commission-
ers shall order the Inspector to immediately make a test of the scales,
weights or measures complained of. Said Inspector shall, however,
have the right to make a test at -any time of any scales, weights,
measures or balances used as aforesaid, whether complaint has been
made or not and shall have the right to change any certificate, there-
tofore issued by him, to conform with the last test made.
Sec. 6. The standard of measures under this ordinance
for berries, fruits and vegetables shall be 67.2 cubic inches for
every container per quart and should any container in which fruits,
berries or vegetables are offered for sale contain less than 67.2
cubic inches per quart, then same shall be stamped upon such con-
tainer.
Sec. 7. Any person who shall buy or sell by any
weights, balances, scales or measures that does not correspond to, or
agree with the weights, measures and balances approved End provided for
by the weights and measures inspector, or sell, use or give any false
weights or measures or shall keep any false weights, measures, scales
or balances for the purpose of buying or selling therewith, or shall
sell any article by weights or measures in violation of this ordinance
shall be fined in any sum not less than '$ 5.00 nor more than � 50.00
for each offense and said inspector shall confiscate and destroy any
such weights, measures, scales or balances which have been tested by
him and shown by him to be short and not up to the standard adopted
by him and which are thereafter used or attempted to be used for the
purpose of giving any false weights or measures of any commodities
sold, weighed or measured by the owner or person in charge thereof.

Sec. B.
Sec. B. Any person who ahtll refuse to permit the
Inspector to make inspections of any weights, measures, scales or
balances owned or operated by him or under his control or shall
prevent or interfere with the inspector so .lining shall be fined,
in each offense, not less than 0 5.00 nor more than $'50.00 and
each and every day that said Inspector is so prevented from making
tests so provided for in this ordinance shall constitute a sepe-
rate offense.
Sec. 9. Said Inspector is hereby empowered to enter
any establishment, building or enclosure or go upon the premises
of any person, firm, company or corporation in the City of Paducah
for the purpose of inspecting any weights, measures, balances or
scales used therein or thereon, at any time, and it shall be un-
lawful for any person to refuse to permit said inspector to enter
thereon or therein for such purposes.
Sec. 10. Said Inspector shall have the power to stop
any person, conveying by vehicle of any character, any article of
merchandise for the purpose of inspecting the dimensions or the
weight of said vehicle or to weigh or inspect any article of
merchandise or container in such vehicle or to ascertain whether
they comply with the terms and -conditions of this ordinance, and
shall have the right to require said vehicle or the contents
thereof to be weighed on the City Scales or any other scales in
the City of Paducah which have been inspected by said'Inspector.
Sec. 11. Any person, firm, company or corporation
violating any of the provisions of this ordinance or refusing to
comply with any of the orders of the Inspector, under the terms
of this ordinance, except as others^ise*herein provided, shall
be fined not less than r? 5.00 nor more than 4 50.00 for each
offense.
Sec. 12. This ordinance shall take effect from and
after its adoption.
