Ellen and C. T. Allen on the 10th day of April, 1916, whereby they agreed to construct said. sewer under the terms and condi- tions of the contract entered into with the said 77eikel, and the said George E. Allen, having assigned his interest ii_ said contract to C. T. Allen, and the said C. T. Allen having complied with all the terms and provisions of svid contract, and said work having been accepted by the City of Paducah, and it appearing- that there is a balance due the said Allen, for said work done and performed and materials furnished in the construction of said se,>rer, the stun of Thirty-one Hundred(, 3100.00) Dollars; and, WHEREAS, in addition to the cork done and performed and the No. 1 7,Y_ _ Ordinance 1, materials furnished in the construction of said seaor, the said Allen is trilling to deed to the City of Paducah, Kentucky, a strip of ground Sixty (60) feet wide, running from Jefferson Street to Broadway Street, .for the i amount owing him, to -,,:it: Thirty-one Hundred (,;3100.00) Dollars, -sh.ich Sixty (60) foot strip is described as follows, to -wit: "Jill. of lots 11os. 5 and 22, Block 1 Fountain Park Addition; and also 6 feet off of the East side of Lot -,"21 and Lot No. 4, and 4 feet off of the '.lest side of Lot Re. 6 and Lot I'Io. 23, Block 1 Fountain Park Addition to the City of Paducah, Kentucky, said 60 foot strip running the entire length of said lots, from Jefferson Street to Broad Street, making the street 60 feet aide." l?ow, therefore; BE IT ORDAIId3D BY 'T.;L] BOARD OF 0011,1ISSIOI BES OF THE CITY OF P'_DUCAH, iCF ZUCY.Y: SEC TION 1. i That F. 'J. Katterjohn, 1,layor, is hereby authorized and empowered to purchase said sixty (60) foot strip of ground above described, a par- ticular description of which is set -out in a deed this day executed by C. T. Allen to the City of Paducah, Kentucky. SECTION 2. jThat upon the delivery of a General '':'Iarrant,y :Deed for said pro- perty to the City of Paducah by the said C. T. Allen, arl when said deed of conveyance is accepted. by Resolution of the Board of Commissioners, the:. Commissioner of Iublic Finance is authorized and directed to pay to the said C. T. Allen the sum of Thirty-one Hundred (,;-3100.00) Dollars, out of funds not otherwise appropriated, which stun is in full payment for all work clone and performed, and materials furnished for the construction of said sewer, and in full payment for the property above described.
