BE IT ORDAINED BY THE BOARD OF C0121ISSIONERS OF THE CITY OF PADUCAH, =ITUCKY; SECTION 1. That the sidewalks, curbs and gutters, to,Pether with all neces- sary manholes, intakes, severs and catch basins on both sides of South Eighth Street, from the South property line of Husbands Street to the North curb line of Bachman Street, in the City of Paducah, Kentucky, be, and the same are hereby ordered to be constructed; that said sidewalks, curbs and gutters shall be constructed of concrete material, suitable in all respects for such construction, and all to be done in strict accord- ance with the plans, grades, specifications, widths and profiles on file in the office of the Commissioner of Public Affairs, qnd all of which are adopted as a part of this Ordinance, as fully as if embraced herein or attached hereto and made a part hereof, and marked "A" for more specific identification. SECTION 2. That said work shall be constructed under the direction and supervision of the Commissioner of Public Affairs, and shall be commenced at the time designated by contract for the performance of said work, and completed on or before SEVEN months after the passage and recording of this Ordinance. That the cost of such construction of said sidewalks, curbs and gutters, and the necessary manholes, intakes, catch basins and severs, shall be paid for wholly by the property owners abutting or fronting thereon, on both sides thereof, to be apportioned to and assess'- ed against the property and property owre rs abutting thereon, on both sides thereof, according to the number of front feet abutting thereon, except the corner lots abutting upon said improvement shall pay for the entire cost of all the intersections, in addition to the abutting pro- porty immediately in front thereof. SECTION 4. The Contractor awarded the contract for the work herein pro- vided for shall be paid only from the funds arising from the Special tax bills and assessments against the property abutting the improvement herein provided for, and in no other gray,- except that the said Con- tractor may be paid out of such.bonds as may be issued, in acco-dance with the laws of the City.of Paducah and charter of cities or the second class of the State of Kentucky; and, for the payment of which, said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the Contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be liable to the said Con- tractor for the excess of Fifty (50°x) per cent of the value of any property assessed for the construction of the .-Fork herein provided for. SECTION 5. The Contractor awarded the contract herein provided for shall be paid monthly by Improvement Warrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public Affairs, to the extent of sixty-five (65%) per cent of the value of the work done or materials furnished by the Contractor during the pronxess of the work, and said Improvement Warrants shall bear six (6%) per cent interest from date of issue, and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioners. Said Improvement I Warrants shall be negotiable, and shall constitute a lien upon the local taxes to be hereafter levied for such improvement, and shall be payable j I at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the work herein provided for, out of the first collection of such local taxes, or out o£ the proceeds of the sale of any ymprovement Bonds issued in anticipation; of such local taxes. The interest on such Improvement Warrants shall be esti- i mated and assessed as a part of the cost of the improvement herein pro- vided for. Na 'A . Ordinance No. -_ SECTION 6. The Mayor is hereby authorized and directed to execute all written I' contracts and bonds with the successful bidder for the construction of said improvement, as required by law. SECTION 7. Bids shall be received for the construction of said work, accord- ing to plans and specifications made and provided therefcrby the Commis- sioner of Public Affairs, and reported to the Board of Commissioners at the nest Regular or Called meeting,ond said Board of Commissioners shall award contract therefor to the lowest and best bidder, e_,:cept the right is expressly reserved to reject any and all bids, within the discretion of said Board of Commissioners.
