SECTIO11 1.
That the sidewalks, curbs and mi.tters, together with all nec-
essary manholes, intakes, sewers and catch basins on both sides of South
Ninth Street, from the South gutter line of Husbands Street to the ::orth

property line of Elizabeth Street, if extended, and on the South side or j

Husbands Street, from the :test property line of Seventh Street to the I
East property line of Ninth Street, in the Cite of Paducah, r,entucky, be,
and the same are hereby ordered to be constructed; that said sidewalks,
orbs and ;-utters shell be constructed of concrete materifl, suitable in
all respects for such Construction, and all to be done in strict accord-
ance with the plans, gladeo, specifications, widths and profiles on file

in the office of the Commissioner of Iubl.ie Affairs, and all of which are
adopted as a part of this Ordinance as 'fully as if embraced herein or
attached hereto and made a part hereof, and marked "A" for more specific
identification.
SECTION 2.
That said ,.-7ork shall be constructed under the direction and
supervision of the Commissioner of Public Affairs, and shall be commenced
at the time designated by contract for the performance of said work, and
completed on or before SEVEN months after the passage and recording of
this Ordinance.
SECTIOid 3.
That the cost of such construction of said sidewalks, curbs and
gutters, and the necessary manholes, intakes, catch basins and se.ters,
shall be paid for wholly by the property owners abutting or fronting
thereon, on both sides thereof, to be apportioned to and assessed against
the property and property oviners abutting thereon, on both sides thereof,
according to the number of front feet abutting thereon, except the corner
lotS'abut ting u� n said improvement shall pay for the entire cost of all
the intersections, in addition to the abutting property immediately in
front thereof.
SECTION 4.
The Contractor awarded the contract for the work herein provided:
for shall be paid only from the funds arising from the Special tax bills
and assessments against the property abutting the improvement herein pro-
vided for, and in no other way,- except that the said contractor may be
paid out of such bonds as may be issued, in accordance with the laws of
the City of Paducah and charter of cities of the second class of the State
of Kentucky; and, for the payment of which, said tax bills and assessments
may be pledged by the said City of Paducah; and in no event shall the said
City of Paducah be liable to the Contractor for the construction of any of
the work herein provided for, except the said City of Paducah shall be
liable to the said Contractor for the excess of Fifty (50%) per cent of
the value of any property assessed for the construction of the work herein
provided for.
SECTION 5.
The Contractor awarded the contract herein provided for shall
' be paid monthly by Improvement Vlarrants issued by the City of Paducah upon
estimates furnished by the Commissioner of Public Affairs, to the extent
- of sixty-five (65%) per cent of the value of the work done or materials
furnished by the Contractor during the progress of the work, and said
,Improvement 1r7arrants shall bear six (6%) per cent interest from date of
issue, and shall be issued by the Commissioner of Public Finance upon
order of the Board of Commissioners. Said Improvement Ylarrants shall be

negotiable, and shall constitute a lien upon the local taxes to be here-
after levied for such improvement, and shall be payable at the office of
the office of the Commissioner of Public Finance, without notice to the
holder thereof, upon completion and acceptance of the work herein pro-
vided for, out of the first collection of such local taxes, or out of
the proceeds of the sale of any Improvement Bonds issued in antieipatiox
of such local taxes. The interest on such Improvement Warrants shall
be estimated and assessed as a part of the cost of the improvement here
in provided for.
SECTION 6.
The Idayor is hereby authorized and directed to el:ecute all
written contracts and bonds with the successful bidder for the con-
struction of said improvement, as required by law.
SECTION 7.
Bids shall be received for the construction of said work,
according to plans and specifications made and provided therefor by the
Commissioner of Public Affairs, and reported to the Board of Commis-
sioners at the next regular or called meeting, and said Board of Commis
sioners shall award contract therefor to the lowest and best bidder,
except the right is expressly reserved to reject any and all bids,
within the discretion of said Board of Commissioners.
SECTION S.
This Ordinance shall take effect and be in force ten (10)
days after its passage. y
