SECTION 1.
That the curbs and gutters, tonether with the necessary manholes,!
intakes, catch basins and sewers on both sides of Leech Avenue, -from the
property line on the South side of LTorth Tenth Street to the gutter line
on what would be the North side of Eleventh Street, :then improved; also
both sides of Eleventh Street, from the cutter line of the intersection on
what would be the ','lest side of Leech Avenue, if improved, to the East

gutter line on Burnett Street, includin the intersections on said I
Streets, in the City of Paducah, XentneltiT, be, and the some are hereby
ordered to be constructed; that said 7utters shall. be constructed o£ con-
., i
trete material, and the curbing shall be of concrete, suitable in all
respects for such cDnstruction, and all to be done in strict accordance
with the plans, grades, specifications, widths and profiles prepared in
i
the office of the Commissioner of Public Affairs, and all of which are
adopted as a part of this Ordinance as fully as if embraced herein or
attached. hereto and made a part hereof, and are marked "A" for more
specific identification.
SECT IOI1 2.
That said work shall be constructed under the direction and
supervision of the Commissioner of "ublic Affairs, and shall be commenced
at a time desinated by contract for the performance of said work, and
completed on or before SF:VI.' months after the passage and recording of.
this Ordinance.
SECTION 3.
That the cost of such construction of said curbs and -tatters, and
the necessary manholes, intakes, catch basins and se.,iers, shall be paid for
wholly by the property orners abutting or fronting thereon, on both sides
'thereof, to be apportioned to and assessed against the property and proper-
ty owners abutting thereon, on both sides thereof, according to the number
of front feet abutting thereon, except the corner lots abutting upon said
improvement shall "pay for the entire cost of all the intersections, in
addition to the abutting property immediately in front thereof.
SECTION 4.
The Contractor awarded the contract for the work herein provided
for shall be paid only from the fiords arising from the Special Tax Bills
and Assessments against the property abutting the improvement herein pro-
vided for, and in no other way,- except that the said contractor may be

ipaid out of such bonds as may be issued, in accordance with the laws of the
City of Paducah and charter of cities of the second class of the State of
Kentucky, and, for the payment of which, said tax bills and assessments
kaybe pledged by the said City of Paducah; and in no event shall the said
City of Faducah be .liable to the contractor for the construction of any of
the 'cork herein provided for, except the said City of Paducah shall be

liable to the said contractor for the excess of fifty (50j) per cent of the

value of any property assessed for the construction of the work heroin
provided for.
SECTION 5.
The Contractor awarded the contract herein provided for shall
be paid monthly by Improvement Warrants issued by the City of Paducah
upon estimates furnished by the Commissioner of Public Affairs, to the
extent of sixty-five.(65%) per cent of the value of the work done or
materials furnished by the Contractor during the progress of the :pork,
and said Improvement Warrants shell bear six (6p) per cent interest from
date of issue, and shall be issued by the Commissioner of Public Financel
upon order of the Board of Commissioners. Said Improvement ;arrants
shall be negotiable, and shall constitute a lien upon the local taxes
to be hereafter levied for such improvement, and shall be payable at
the office of the Commissioner of Public Finance, without notice to the
holder thereof, upon completion and acceptance of the work herein pro-
vided for, out of the first collection of such local taxes, or out of th
proceeds of the sale of any.Improvement Bonds issued in anticipation of
such local taxes. The interest on such Improvement7arrants shall be
estimated and assessed as a part of the cost of the improvement herein
provided for.
SEC^1IOiI 6.
The Mayor is hereby authorized and directed to execute all
written contracts and bonds with the successful bidder for the con-
struction of said improvement, as required by law.
SECTION 7.
Bids shall be received for the construction of said work,
according to plans and specifications made and provided therefor by the
Commissioner of Public Affairs, and reported to the Board of Commission-
ers at the next regular or called meeting, and said Board of Commission-
ers shall award contract therefor to the lowest and best bidder, except
the right is expressly reserved to reject any and all bids, within the
discretion of said Board of Commissioners. i
SECTION 8.
I
This Ordinance shall take effect and be in force ten (10)
days after
its passage.
