BE IT ORDAINED BY THE BOARD OF 001:MISSIONERS OF THE CITY OF PADU- 01-H, KENTUCKY: SECTION 1. That the curbs and gutters, togetherwith the necessary manholes, intakes, sewers and catch basins on the West side of Broad Street, from the intersection of Fourth and Broad Street, including the intersection at Fourth and Broad Street, to the dividing line between the property of Charlotte Ruff and the property of Barbara Fetter; and also the sidewalks, curbs and gutters, together with the necessary manholes, intakes, sewers and catch basins on the East side of Broad Street, from the intersection of Fourth and Broad Street to the North curb line of Bridge Street, except- ing all concrete sidewalks, curbs and gutters now constructed thereon, in the City of Paducah, Kentucky, be, and the same are hereby ordered to be constructed; that said sidewalks, gutters and curbing shall be constructed of concrete material, suitable in all respects for such construction, and all to be done in strict accordance with the plans, grades, specifications,' widths and profiles prepared in the office of the Commissioner of Public 'Affairs, and all of which are adopted as a part of this ordinance as fully as if embraced herein or attached hereto and made a part hereof, and are marked "A" for more specific identification. SECTION 2. That said work shall'be constructed under the direction and super- vision of the Commissioner of Public Affairs, and shall be commenced at a time designated by contract for the performance of said work, and completed on or before Seven Months after the passage and recording of this Ordinance. SECTION 3. That the :cost of such construction of said sidewalks, curbs and gutters, and the necessary manholes, intakes, catch basins and sewers, shall be paid for wholly by the property owners abutting or fronting there- on, on both sides thereof, to be apportioned to and assessed against the property and property ovmers abutting thereon, on both sides thereof, according to the number of front feet abutting thereon, except the corner lots abutting upon said improvement shall pay for the entire cost of all of the intersections, in addition to the abutting property immediately in front thereof. The Contractor awarded the contract for the work herein provided t for shall be paid only from the funds arising from the Special Tax Bills' and assessments against the property abutting the improvement herein pro- vided for, and in no other way, except that the said Contractor may be paid out of such bonds as may be issued., in accordance with the laws of the City of Paducah and charter of cities of the second class of the State of Kentucky, and for the payment of which, said tax bills and assess- ments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the Contractor for the construction., of any of the work herein provided for, except the said City of Paducah shall be liable to the said Contractor for the excess of Fifty (50o) per I cent. of the value of any property assessed for the construction of the work herein provided for. SECTION 5. ` The Contractor awarded the contract herein provided for shall be paid monthly by Improvement Tarrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public Affairs, to the extent of sixty-five (650) per cent. of the value of the work done or materials I furnished by the Contractor during the progress of the work, and said I Improvement Warrants shall bear six (6%) per cent. interest from date of issual and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioners. Said Improvement warrants shall be negotiable, and shall constitute a lien'upon the local taxes to be here- after levied for such improvement, and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the work herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale I! of any Improvement Bonds issued in anticipation of such local taxes. The I interest on such Improvement Warrants shall be estimated and assesed as i a part of the cost of the improvement herein provided for. SECTION 6. II The Mayor is hereby authorized and directed to execute all I written contracts and bonds with the successful bidder for the construc- tion of said improvement, as required by law. SECTION 7. This Ordinance shall take effect and be in force Ten (10) days after its passage. RECORDED APRIL 26th, 1921. PUBLISHED 11 26th, 1921. Mayor.
