HomeMy WebLinkAboutOrdinances Book 7, Page 707, No Ordinance NumberAPF ORDINANCE PROVIDING FOR THE CONSTRUCTION OF CONCRETE SIDEWALKS, CURBS AND GUTTERS, AND ALL NECESSARY I:ANHOLES, INTAKES, SEDERS AND CATCH BASINS ON BOTH SIDES OF FOURTH STREET, FROIJ THE NORTH PROPERTY LINE OF BROAD STREET TO THE SOUTH GUTTER LIRE OF ELIZABETH STREET, IN THE CITY OF PADUCAH, KENTUCKY, AT THE COST OF THE ABUTTING PROPERTY OWN—PRS, AND PRO" VIDING THAT SAI,M I,TAY BE PAID FOR ON THE TEN YEAR PAYIlMNT PIAN. .BE IT ORDAINED BY THE BOARD OF COT-31ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the sidewalks, curbs and gutters, together with the necessary manholes, intakes, catch basins and sewers :;n both sides of Fourth Street from the North property line of Broad Street to the South gutter line of Elizabeth Street, in the City of Paducah, Kentucky, be, and the same are hereby ordered to be constructed; that said sidewalks, gutters and curbing shall be constructed of concrete material, suitable in all respects for such construction, and all to be done in strict accordance with the plans, grades, specifications, widths and profiles prepared in the office of the Commissioner of Public Affairs, and all of which are adopted as a part of this Ordinance as fully as if embraced herein or attached hereto and Ordinance No. made a part hereof, Arid are marked "A" for more poeific identification. SECTION 2. That said work shall be constructed under the dir e:tion and supervision of the Commissioner of Public Affairs, and shall be commenced at a time designated by contract for the performance of said work, and completed on or before SEV:M months after the passage and. recording of this Ordinance. SECTION 3. That the cost of such construction of said sidewalks, curbs and gutters, and the necessary manholes, intakes, catch basins and sewers, shall be paid for wholly by the property owners abutting or fronting thereon, on both sides thereof, to be apportioned to and assessed against the property and property owners abutting thereon, on both sides thereof, according to the number of front feet abutting thereon, except the corner lots abutting upon said improvement shall pay for the entire cost of all of the intersections, in addition to the abutting property immediately in front thereof. SECTIOIJ 4. The Contractor awarded the contract for the work herein pro- vided for shall be paid only from the funds arising from the Special Tax Bills and assessments against the property abutting the improve- ment herein provided for, and in no other way, except that the said Contractor may be paid out of such bonds as may be issued, in accordance with the law of the City of Paducah and charter of cities of the second class of the State of I.entucky, and for the payment of which said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the Contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be liable to the said Contractor for the excess of fifty (50%) per cent. of the value of any property assessed for the con- struction of the work herein provided for. SECTIOIZ 5. The Contractor awarded the contract herein provided for shall be paid monthly by`�provement 'r7arrants issued by the City of Paducah upon estimates furnished by the Commissioner of Public Affairs, to the extent of sixty-five (650) per cent. of the value of the work done or materials furnished by the Contractor during the progress of the work, and said Improvement Warrants shall bear six (6%) per cent. interest from date of issual and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioners. Said Improvement Warrants shall be negotiable, and shall constitute a lien upon the local taxes to be hereafter levied for such improvement, and shall be payable at the office of the Commissioner of Public Finance, withouth notice to the holder thereof, upon completion and acceptance of the work herein Ne.. -P Ordinance No.__._____ provided for, out of the first collection of such local taxes, or out of the proceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The interest on such Improvement Warrants shall be estimated and assessed as a part of the cost of the improvement herein provided for. SECTION 6. The Mayor is hereby authorized and directed to execute all written contracts and bonds with the successful bidder for the construction of said improvement, as required by law. SECTION 7.
