WHEM S, the General Assembly of the Commonwealth of Kentuchy, by

pealed an Act of the General assembly of the State of Kentucky entitled

by the Governor Liarch 23, 1910, and appearing as Chapter 90 of the rets
of the General 1ssembly of the State of Kentuc3W for 1910; and
V.hEREAS, it is deemed expedient that the City of Paducah should
have a ';eights and Measures Inspector fox the City of Paducah, there-
. - fore,
BE IT ORDAIIIED BY THE BOARD OF COi�dISSIOIIERS OF
THE CITY OF PADUC di, KEIITUCKY:
Section 1. That the Commissioners of the City of Paducah shall be and
they are hereby emroviered to employ a Cei?hts and Lleasures Irspecto-r
for the City of Paducah.
Section 2. That it shall be the duty of said V,eights and i.:easures In-
spector to test, at least once a year, all weights, measures, balances,
scales, steel yards or beams, in the City of Paducah, ovined or used by
any person, firm, company or corporation engaged in buying or selling
merchandise, groceries, produce, poultry, grain, provender, meats,coal
ice, feed stuffs, iron,- rags, metal, junk, wares, wool, hides, leather,
or any other article of trade or commerce - also horses, cattle, sheep,
hogs, or other live steel_, :,nd -:;ho are using or shall use said sc>.Lles,
weilghts or measures for ddtermining the weaght ofany of said articles
in either selling; or buying same. Said Ir_spector shall also test all
public scales where commodities of live stock are weighed, and for
which fees are charged.
Section 3. Said Inspector shall receive as compensation_ the following
fees: -
.nor testing each platform scale, ordinarily used in weighing
live stock, coal, grain, provender, wagons and heavy axticles of life
character ti?1.50 (except the City Scales, owned and operated by
the City of Paducah, which shall be tested in accordance with this
Ordinance, but for ti:hich no fee may be charged); for testing each
steel yard, balance, beam, or any other scales ......ti}0.25, and for
testing each weight and measure ......N0.05; said fees to be paid
by the oviner, operator or person in possession of said scales, weights
and measures.
Section 4. The Inspector, after mah inv; any of the tests provided for
herein, shall deliver to the omen or operator of said scales, weights,
measures and balances so tested, a Certificate - setting forth the

articles tested, the result and date of the test, - and the Inspector
shall keep a complete record of all tests made, and on the first L?onday
in each month shall file in the Clerk's office of the County Court a •
statement over his signature, showing the tests, if any, made by
him during the previous month.
Section 5. Upon complaint of any person made by affidavit before the
Board of Commissioners of the City of Paducah, stating that he has
been cheated or defrauded by the use of any scales, balances or
measures, within thirty days previous to said complaint, the Board
of Commissioners shall order the Inspector to immediately make a test
of the scales, weights or measures complained of. If same are inac-
curate in any respect, the owner, operator, or person in charge of
the scales, weight's or measures complained of, shall pay the fees
o -f the inspection; in addition to other penalties prescribed by law.
In the event that said scales, weights or measures complained of are
not found to be inaccurate, the complainer shall pay the fee for
testing, in accordance with this ordinance, The Inspector shall
have the right to make .a test at any time, whether complaint is made
or not, but there shall be no fees charged for such additional in-
spection, and only one fee shall be charged for each inspection per
,year of the same scales, except where complaint is made, as herein-
before provided.
Section 6. The standard of Eeasures under this Ordinance for berries,
fruits and vegetables shall be si_a y -seven and trio -tenths (67.2)
cubic inches for every container per quart, and should any container
in which fruits, berries or vegetables are offered for sale contain
less than 67.2 cubic inches per quart, then sac,.e shall be stamped
upon such container.
Section 7. luny person who shall buy or sell by any weight, balance,
scales or measures that do not correspond to or agree with the
weights, measures and balances approved and provided for by the
Weights and 1,:easures Inspector, or shall use or give any false
weights or measures, or shall keep any false weights, measures, scales
Or balances on hand for the'purpose of buying or selling therewith,
or shall sell any article by any i,eight or 1,7easure in violation of
this Ordinance, shall be fined in any sum not less than five (N5.00)
dollars nor more than fifty (:;50.00) dollars for each offense, or for
a, li'•:e sum for each and every month he continues to ;:eep the false
weights, measures, scales, or balances on hand, or continues to sell
by any such false Weight or 1, ensure.
Any person who shall .refuse to permit the Inspector to make
a test of weights, measures, scales or balances, owned or operated by
him, or under his control, or shall prevent or interfere with the

Inspector in so doing, or shall refuse to pay the fees for testing,
after same has been made, shall be fined in each offense not less than
five (tir5.00) dollars nor more than fifty (y50.00) dollars, and each
and every day the said Inspector is so prevented from making the test
provided for in this Ordinance shall constitute a separate offense.
ction 8. This Ordinance shall take effect from and after its passage.
