HomeMy WebLinkAboutOrdinances Book 7, Page 670, No Ordinance NumberAN ORDINANCE PROVIDING FOR THE CONSTRUCTION AND RECONSTRUCTION OF THE DRIVEWAY ON SOUTH FIFTH STREET, FROM THE SOUTH PROPERTY LINE OF KENTUCKY AVENUE TO THE NORTH PROPERTY LINE OF CLARK STREET, BEING AP- PROXIIOIATELY 759 LINEAR FEET, IN THE CITY OF PADUCAH, KENTUCKY, AT THE COST OF THE ABUTTING PROPERTY WMERS, AND PROVIDING THAT SAID INPROVE- 10ENT,SHALL BE MADE UPON THE TEN YEAR PAYPIIENT PLAN. BE IT ORDAINED BY THE BOARD OF COM11-ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the driveway on South Fifth Street, from the South proper- ty line of Kentucky Avenue to the North property line of Clark Street, being approximately 759 Linear Feet, in the City of Paducah, Kentucky, be, and the same is hereby ordered to be constructed and reconstructed; that said street shall be constructed and reconstructed with concrete, tarvia, Kentucky Rock. Asphalt, or any other improved paving material, as may be determined by the Board of Commissioners as the best and most economical material for the construction thereof, upon bids made therefor, and all to be done in strict accordance with the plans, grades, specifications, widths and profiles of the Commissioner of Public Affairs, prepared by him for such purpose, all of which are adopted as a part of this Ordinance, as fully as if embraced herein or attached hereto and made a part hereof, and marked "A" for more specific identification. SECTION 2. That said work shall be constructed under the direction and supervision of the Commissioner of Public Affairs, and shall be com- menced at a time designated by contract for the performance of said work, and completed on or before TEN months after the passage and re- cording of this ordinance. SECTION 3. That the cost of such construction of said street shall be paid for wholly by the property owners abutting or fronting thereon, on both sides thereof, to be -apportioned to and assessed against the pro- perty owners abutting thereof, on both sides thereof, according to the number of front feet abutting thereon, except that the City of Paducah shall pay such portion of such cost of construction as required by law. No._611 Ordinance No._ SECTION 4. The contractor awarded the contract for the work herein provided for shall be paid only from the funds arising from the Special Tax Bills and assessments against the property abutting the improvement herein pro- vided for, and in no other way,- except that the said contractor may be paid out of such bonds as may be issued, in accordance with the law of the City of Paducah and charter of cities of the second class of the State of .Kentucky; and, for the payment of which, said tax bills and assessments may be pledged by the City of Paducah; and in no event shall the said City of Paducah be liable to the contractor for -the construction of any of the work herein provided for, except that the said City of Paducah shall be -liable to the said contractor for the excess of Fifty (500) per cent of the value of any property assessed for the construction of the work herein provided for. SECTION 5. The contractor awarded the contract herein provided for may be paid monthly by Improvement Vlarrants, issued by the City of Paducah upon estimates furnished by the Commissioner of Public Affairs,�to the extent of Sixty-five (651%) per cent of the value of the work done, and. said im- provement FJarrants shall bear six (61%o) per cent interest from date of issue, and shall,be issued by the Commissioner of Public.Finance upon order of the Board of Commissioners. Said Improvement Vlarrants shall be negotiable, ,and shall constitute a lien upon the local taxes to be hereafter levied for such improvement, and shall be payable at the office of the Commission- er of Public Finance, without notice to the holder thereof, upon comple- tion and acceptance of the work herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The inter- est on such Improvement Warrants shall be estimated and assessed as a part of the cost of the improvement herein provided for. SECTION 6. The Mayor is hereby authorized and directed to execute all written contracts and bonds with the successful bidder for the construction of said improvement, as -required by late. SECTION 7. Bids shall be received for the construction of said work out of concrete, tarvia, Kentucky Rock Asphalt, or any other improved paving material, according to plans and specifications made and provided therefor by the Commissioner of Public Affairs; and reported to the Board of Com- missioners at the next regular or called meeting, and said Board of Commissioners shall determine the material with which said street shall be constructed, and award the contract therefor to the lowest and best bidder, except the right is expressly reserved to reject any and all bids, within No. In-` ) Ordinance No. _ _____. __ the discretion of said Board of Commissioners.
