HomeMy WebLinkAboutOrdinances Book 7, Page 620, No Ordinance NumberNo.'� _�26 Ordinance No.— AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF CONCRETE SIDE- YlALKS, CURBS AND GUTTERS, AND ALL NECESSARY MANHOLES, INTAKES, SEWERS I AND CATCH BASINS, ON TH2 WEST SIDE OF GOEBEL AVENUE FROM THE EAST PRO- ' PERTY LINE OF GUTERIE AVENUE TO A POINT l"!HERE THE SOUTH CURB LINE OF i WORTEN'S AVENUE, IF EXTENDED, WOULD INTERSECT THE 'WEST PROPERTY LINE OF GOEBEL AVENUE; AND ON THE EAST SIDE OF GOEBEL AVENUE FROM THY NORTH CURB LINE OF TENNESSEE STREET TO THE SOUTH CURB LINE OF WORTEN'S AVENUE; IN THE CITY OF PADUCAH,KENTUCKY, AND PROVIDING THAT SALS MAY BE PAID FOR UPON THE TEN YEAR PAYMENT PLAN. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY; SECTION 1. That the sidewalks, curbs and gutters, together with the neces- sary manholes, intakes, catch basins and sewers on the hest side of Goebel Avenue from the East property line of Guthrie Avenue to a point I where the South curb line of Worten's Avenue, if extended, would inter- sect the !'lest property line of Goebel Avenue; and on the East side of. Goebel Avenue from the North curb line of Tennessee Street to the South curb line of 70rten's Avenue, in the City of Paducah, Kentucky, be, and the same are hereby ordered to be constructed; that said sidewalks and gutters shall be constructed of concrete material and the curbing shall! be of concrete, suitable in all respects for such construction, and all to be done in strict accordance with the plans, grades, specifications,, widths and profiles prepared in the office of the Commissioner of :Public Works, and all of which are adopted as a part of this Ordinair e as fully as if embraced herein or attached hereto and made a -part hereof, and are marked "A" for more specific identification. i SECTION 2. That said work shall be constructed under the direction and su- i pervision of the Commissioner of Public 7orks, and shall be commenced at a time designated by contract for the Performance of said work, and completed on or before Seven months after the passage and recording of this Ordinance. SECTION 3. That the cost o£ such construction of said sidewalks, curbs and gutters, and the necessary manholes, intakes, catch basins and sewers, shell be paid for wholly by the property Owners abutting or fronting thereon, on both sides thereof, to be apportioned to and assessed against the property and property owners abutting thereon, on both sides there- of, according to the number of front feet abutting thereon, except the corner lots abutting upon said improvement shall pay for the entire cost of all of the intersections, in addition to the abutting property immediately in front thereof. SECTION 4. No. l Ordinance No.__ The contractor awarded the contract for the work heroin provided for shall be paid only from the funds arising from the Special tax bills i and assessments a,g:a.inst the property abutting the improvement herein pro- vided for, and in no other way, except that the said contractor may be paid out of such bonds as may be issued, in accordance with the law of the', City of Paducah and charter of cities of the second class of the State of Kentucky, and for the payment of which 'said tax bills and assessments may be pledged by the said City of Paducah; and in no event shall the said- City aidCity of Paducah be liable to the contractor for the construction of any of the irork herein provided for, except the said City of Paducah shall be liable to the said contractor for the excess of fifty (50%) per cent of the value of any property assessed for the construction of the work herein provided for. SECTION 5. The contractor awardecl the contract herein provided for shall be paid monthly by Improvement 'Jarrants, issued by the City of Paducah upon estimates furnished by the Commissioner of Public !.forks, to the extent of sixty-five (65%) per cent. of the value of the work done :,r materials fur- nished by the contractor during the progress of the work, and said Improve— ment "Arrants shall bear six (6�',) per cent. interest from date of issual and shall be issued by the Commissioner of Public Finance upon order of the'. Board of Commissioners. Said Improvement :+a-rrants shall be negotiable, and. shall constitute a lien upon the local taxes to be hereafter levied_ for such improvement, and shall be payable at the office of the Commissioner of i Public Finance, without notice to the holder thereof, u-gon completion and ! acceptance of the work herein providecl for, out of the first collection of such local taxes, or out of the m-oceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The interest on such Improvement '.^arrants shall be estimated and assessed as a part of the cost of the improvement herein provided for. SECTIOid 6. This Ordinance shall take effect and be in force ten (10) days after same is adopted and recorded; provided petition, according to law, for a referendum vlotep hereon, has not been filed within said ten days.
