WHERE THE PRESENT CONCRETE BALKS, ETC. STOP IN FRONT OF J. C. KOLB'S
RESIDENCE ON THE SOUTHERLY SIDE OF BROAD STREET, AND RUNNING TO THE EAST
CURB LINE OF BRIDGE STREET; ALSO ON THE NORTHERLY SIDE OF BROAD STREET

BE IT ORDAINED BY THE BOARD OF COI'J,'IISSIONERS OF THE CITY OF PADU-
CAH KENTUCKY:
' SECTION 1.
That the sidewalks, curbs and gutters, together with the necessary
manholes, intakes, catch basins and sewers on both sides of Broad Street,
between Sixth Street and Bridge Street, beginning at a point on Broad
Street where the present concrete walks, etc. stop in front of J. C.
Kolb's residence on the Southerly side of Broad Street, and running to
the East cimb line of Bridge Street; also on the Northerly side of Broad-
Street
roadStreet from the present concrete intersection at the northerest corner of
Sixth and Broad Street to a point where the East curb line of Bridge'
Street would intersect the northerly property line of Broad Street, if
same was extended across Broad Street, in the City of Paducah, Kentucky,'
be and the same are hereby ordered to be constructed; that said side-
walks and gutters shall be constructed of concrete or Kentucky Rock
Asphalt material and the curbing shall be of reenforced concrete, suit-
able in all respects for such construction, and all to be done in strict.

SECTION 2.
That said work shall be constructed under the direction and super
i
vision of the Commissioner -of Public Works, and shall be commenced at a
time designated by contract for the performance of said work, and completed
on or before Seven months after the passage and recording of this Ord_i-
nanee.
SECTION 3.
That the cost of su.ch construction of said sidewalks, curbs and
gutters, and the necessary manholes, intakes, catch basins and sewers,
shall be paid for wholly by the property owners abutting or frontin.- there
on, on both sides thereof, to be apportioned to and assessed against the
property and property owners abutting thereon, on both sides thereof,
according to the number of front feet abutting thereon, except the corner
lots abutting upon said improvement shall pay for the entire cost of all of,
the intersections, in addition to 'the abutting property immediately in i
front thereof.
SECTION 4.
The contractor awarded the contract for the work herein provided
for shall be paid only from the funds arising from the Special tax bills
and assessments against the property abutting the improvement herein pro-
vided for, and in no other way, except that the said contractor may be paid
out of such bonds as may be issued, in accordance with the law of the City
of Paducah and charter of cities of the second class of the State of Ken-
tucly, and for the payment of which said tax bills and- assessments may be
pledged by the said City of Paducah; and in no event shall the said City of
Paducah be liable to the contractor for the construction of any of the .fork
herein provided for, exce-ot the said City of Paducah.shall be liable to the
said contractor for the excess of fifty (50%) per cent. of the value of any
property assessed for the construction of the ^ork herein provided for.
SECTION 5.
The contractor awarded the contract herein provided for shall be
paid monthly by Improvement t"larrants, issued by the City of Paducah upon
estimates furnished by the Commissioner of Public Plonks, to the extent of
sixty-five (65%) per cent. of the value of the work done or materials fur-
nished by the contractor during the progress of the work, and said Im_orove
ment ';larrants shall bear six (6f) per cent. interest from date of issual
and shall be issued by the Commissioner of Public Finance upon order of the.
Board of Commissioners. Said Improvement 'aar.rants shall be negotiable,
and shall constitute a lien upon the local taxes to be hereafter levied
:for such improvement, and shall be payable at the office of the Commission-.

of such local taxes, or out of the proceeds of the sale of any Improvement

This Ordinance shall take effect and be in force ten (10) days
after same is adopted and recorded; provided petition, according to
for a referendum vote hereon, has not been riled within said ten days.
