BE IT ORDAINED BY THE BOARD OF COIaMTISSIONERS OF,`['HE CITY OF � PADUCAH, ICiTTUCKY: SECTION 1. That the sidewalks, curbs and gutters, together riith the necessary manholes, intakes, catch basins and sewers on both sides of South Seventh Street, from the South property line of Jackson Street to the North property line of Jones Street, in the City of Paducah, Ken- tucky, be, and. the same are hereby ordered to be constructed; that said sidewalks and gutters shall be constructed of concrete or Kentocky Rock Asphalt material and the curbing shall be of reenforced concrete, suit- able in all respects for such construction, and all to be done in strict accordance with the plans, grades, specifications, widths and profiles prepared in the office of the Commissioner of Public 'i;orks, and all of which. are adopted as a pest of this Ordinance as fully as if embraced herein or attached hereto and made a pert hereof, and are rarked "A° for more specific identification. SECTIOP 2. That said work shall be constructed under the 0-irection and supervision of the Commissioner of Public Works, and shell be commenced! i No' Ordinance at a time designated by contract for the performance of said work, and jcompleted on or before six months after the passage and recording of this Ordinance. SECTIONT 3, That the cost of such construction of said Sidewalks, curbs and ,gutters, and the necessary manholes, intakes, catch basins and sewers, shall be paid for wholly by the property owners abutting or fronting there- on, on both sides thereof, to be apportioned to and assessed against the property and property owners abutting thereon, on both sides thereof, according to the number of front feet abutting thereon, except the corner ,lots abutting upon said improvement shall pay for the entire cost of all of the intersections, in addition to the abutting property immediately in front thereof. SECTION 4. The contractor awarded the contract for the work herein provided for shall be paid only from the funds arising from the Special tax bills and- assessments against the -property abutting the improvemnt he -rein pro- vided- for, and in no other way, except that the said contrac r may be paid out of such bonds as may be issued, in accordance with the law of the City of Paducah and charter of cities of the second class of the State of Ken - Lucky, and for the xa.yment of which said tax bills and assessments may be »ledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to the contractor for the construction of any of the work herein -provided for, except t_e City of Paducah shall be liable to the said contractor for the excess of fifty (50%) per cent. of the value of any pro-; perty assessed for the construction of the work herein provided for., SECTION 5. The contractor awarded the contract herein provided for shall be paid monthly by Improvement Warrants, issued by the City of Paducah upon estimates furnished by the Commissioner of Public Ifforks, to the extent of sixty-five (65%) per cent. of the value of the work done or materials fur- nished by the contractor during the progress of the work, and said Improve- ment Warrants shall bear six Wo) per cent. interest from date of issual and shall be issued by the Commissioner of Public Finance upon order of the Board of Commissioners. Said Improvement Plarrants shall be negotiable, and shall constitute a lien upon the local taxes to be hereafter levied for such improvement, and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the work herein provided for, out of the first collection of such local taxes, or out of the proceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The interest on such Improvement !;'larrants shall be estimated- and assessed as a na.rt of the cost of the improvement herein provided for.
