TY LINE OF TRIMBLE STREET, IN THE CITY OF PADUCAH, KENTUCKY, AND PROVIDING
THAT THE SAME SHALL BE CONSTRUCTED UPON THE TEIJ YEAR PAYI!IFEIIT PLAN AT THE
COST OF THE ABUTTI14G PROPERTY OWNERS.

BE IT ORDAINED BY THE BOARD OF COINdISSIONERS OF THE CITY OF PP.DUCAH'
Iz NTUCKY:
SECTION 1.
That the sidewalks, curbs and gutters, together with the necessary
manholes, intakes, catch basins and sewers on both sides of North Eighth
Street, from the North property line of Monroe Street to the South proper-
ty line of Trimble Street, in the City of Paducah, Kentucky, be, and the
same are hereby ordered to be constructed; that said sidewalks and gutters
shall be constructed of concrete or Kentucky Rock Asphalt material and the
curbing shall be of reenforced concrete, suitable in all respects for such
construction, and all to be done in strict accordance with the plans,

grades, specifications, widths and profiles prepared in the office of the ,
Commissioner of Public Works, and all of which are adopted as a part of
I
this Ordinance as fully as if embraced herein or attached hereto and made
I
a part hereof, and are marked "A" for more specific identification.
SECTION 2.
That said work shall be constructed under the direction and super-
vision of the Commissioner of Public '.Works, and shall be commenced at a
time designated by contract for the performance of said work, and com-
pleted on or before six months after the passage and recording of this
Ordinance.
SECTION 3.
That the cost of such construction of said sidewalks, curbs and
gutters, and the necessary manholes, intakes, catch basins and sewers,
shall be paid for wholly by the property owners abutting or fronting
thereon, on both sides thereof, to be apportioned to and assessed against

the property and property owners abutting thereon, on both sides thereof,
according to the number of front feet abutting thereon, except the corner
lots abutting upon said improvement shall -ray for the entire cost of all
of the intersections, in addition to the abutting property immediately in
front thereof.
SECTION 4.
The contractor awarded the contract for the work herein provided
for shall be paid only from the funds arising from the Special tax bills
and assessments against the property abuttino- the improvement herein pro-
vided for and in no other wa exce-ot that at the said contractor may be

paid out of such bonds as may be issued, in accordance with the law of ,the

City of Paducah and charter of cities of the second class of the State
of Kentticky, and for the payment of which said tax bills and assess-
ments may be pledged by the said City of Paducah; and in no event shall
the said City of Paducah be liable to the contractor for the construction
of any of the work herein provided for, except the said City of Paducah
shall be liable to the said contractor for the excess of fifty (50
per cent. of the value of any property assessed for the construction of
the work herein provided for.
SECTION 5.
The contractor awarded the contract herein provided for shall
be paid monthly b -T Improvement Vlarrants, issued by the City of Paducah
upon estimates furnished by the Commissioner of Public .forks, to the
extent of sixty-five (65%) per cent. of the value of the work done or

materials furnished by the contractor during the progress of the work,
nd ,aid I-.�pi'ovement tjarrants shall bear six (6%) per cent. interest
from date of isstra.l and shall be issued by the Commissioner of Public
Finance upon order of the Board of Commissioners. Said Irrnprovennnt
'Clar-rants shall be negotiable, and shall c onstitute a lien upon the local.
taxes to be hereafter levied fo-r such improvement, and shall.be -paya:ble!
at the office of the Commissioner of Public Finance, without notice to
the holder thereof, upon completion and acceptance of the work herein
provided for, out of the first collection of such local taxes, or out
of the proceeds of the sale of any Improvement Bonds issued in antici-
pation of such local taxes. The interest on such Improvement 'Jarrants
shall be estimated and assessed as a part of the cost of the improve-
ment herein provided for.
SECTION 6.
This Ordinance shall take effect and be in force ten (10) days
after same is adopted and.recorded; provided petition, according to law,
for a referendum vote hereon, has not been filed within said ten days.
