BE IT ORDAINED BY THE BOARD OF COIJ111ISSIONERS OF THE CITY OF PADU- CAH, IENTUCKY: SECTION 1. That the sidewalks, curbs and gutters, together with the necessary; manholes, intakes, catch basins and servers on both sides of North Thir- teenth Street, from the North property line of Broadway Street to the South property line of Trimble Street, in the City of Paducah, Kentucky, be, and the same are hereby ordered to be constructed; that said sidewalks and gutters shall be constructed of concrete or Kenta.cky Rock Asphalt material and the curbing shall be of reenforced concrete,suitable in all respects for such construction, and all to be done in strict accordance with the plans, grades, specifications, widths and profiles prepared in the office of the Commissioner of :Public 1r'orks, and all of which are adopted as a part of this Ordinance as fully as if embraced or attached hereto and made a part hereof, and are marked "A" for more specific identi-' fication. That said work shall be constructed under the direction and � supervision of the Commissioner of Public 4lorks, and shall be commenced at a time designated by contract for 'the performance of said work, and completed on or before six months after the passage and recording of this Ordinance. SECTION 3. That the cost of such construction of said sidewalks, clubs, and gutters, and the necessary manholes, intakes, catch basins and i sewers, shall be �,id for wholly by the property ovaiers abutting or j fronting thereon, on both sides thereof, to be apportioned to and as- sessed against the property and property oviners abutting thereof, on both sides thereof, according to the number of front feet abutting thereon, except the corner^lots abutting upon said improvement shall pay for the entire cost of all of the intersections, in addition to the; abutting property immediately in front thereof. SECTION 4. The contractor awarded the contract for the work herein pro- ! vided for shall be paid only from the funds arising from the Special tax bills and assessments against the property abutting the improve- ment herein rrovided for, and in no other way, except that the said contractor may be paid out of such bonds as may be issued, in accord- ance with the law of the City of Paducah and charter of cities of the second class of the State of Kentucky, and for the payment of which said tat: bills end assessments may be pledged by the said City of Paducah; and in no event shall the said City of Paducah be liable to I the contractor for the construction of any of the work herein provided for, except the said City of Paducah shall be liable. to the said con- tractor for the excess of fifty (50%) per cent. of the value of any property assessed for the construction of the work herein provided for. SECTION 5. The contractor awarded the contract herein provided for shall be paid monthly by Improvement Ti,farrants, issued by the City of Paducah upon estimates furnished by the Commissioner of Public Works, to the extent of sixty-five (65%) per cent. of the value of the work done or materials furnished by the contractor during the progress of the work, and said Improvement Warrants shall bear six (60) per cent. interest from date of issual and shall be issued by the Commissioner of Public Finance upon order of the Boa -rd if Commissioners. Said Impzpvement warrants shall be negotiable, and shall constitute a lien upon the local taxes to be hereafter levied for such improvement, and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder thereof, upon completion and acceptance of the work herein provided. for, out of the first collection of such local taxes, or out No. l'/J0 Ordinance No._- -- ----- of the proceeds of the sale of any Improvement Bonds issued in anticipation of such local taxes. The interest on such Improvement Warrants shall be 'estimated and assessed as a part of the cost of the improvement herein Pro- vided for. SECTION 6. This Ordinance shall take effect and be in force ten (10) days after same is adopted and recorded; provided petition, according to lave, for a referendum vote hereon, has not been filled within said ten dans.
