AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF CONCRETE OR i

SEVENTY LINEAL FEET, IN THE CITY OF PADUCAH, KEI:TUCKY, AND .PROVIDING TI -LIT
THE SAME SHALL BE CONSTRUCTED UPON THE .TEM YEAR PAY:4ENT PLAN AT THE COST
OF THE ABUTTING PROPERTY OWNERS.
BE IT ORDAINED BY THE BOARD OF COIID,SISSIOIXTERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTIOPT 1.
That the sidewalks, curbs and gutters, together with the
necessary imnholes, intakes, catch basins and se.,iers on the Vlest side

of North Twelfth Street, beginning at the concrete sidewalk on the pro-,
i
perty of J. DuPerrieu and extending to the concrete sidewalk on the pro:-
perty of the Henderson Brewing Company, a distance of approximately
seventy lineal feet, in the city of Paducah, Kentucky, be, and the same)
are hereby ordered to be constructed; that said sidewalks and gutters
shall be constructed of concrete or Kentucky Rock Asphalt material and
the curbin- shall be of reenforced concrete, suitable in all respects
for such construction, and all to be done in strict accordance with the'
_plans, grades, specifications, widths and profiles prepared in the
office of the Commissioner of Public Works, and all of wnich are adopt-;
ed as a part of this Ordinance as fully as if embraced herein or at-
tachefl hereto and made a part hereof, and are marked "A" for more
specific identification.
SECTION 2.
That said work shall be constructed under the direction and
supervision of the Commissioner of Public Works, and shall be commenced,
at a time designated b, contract for the performance of said work, and
completed on or before six months after the passage and recording of
this Ordinance.
SECTION 3.
That the cost of such construction of said sidewalks, curbs
and gutters, and the necessary manholes, intakes, catch basins and
sewers, shall be �.id for wholly by the property owners abutting or
fronting thereon, on both sides thereof, to be apportioned to and
assessed against the property and property owners abutting thereon, on
"Goth sides thereof, according to the number of front feet abutting
thereon, except the corner lots abutting upon said improvement shall
pay for the entire cost of all of the intersections, in addition to the'i
abutting property immediately in front thereof.

The contractor awarded the contract for the work herein provided
for shall be paid only from the funds arising from the Special tax bills
and assessments against the property abutting the improvement herein pro-
vided for, and in no other way, except that the said contractor may be
paid out of such bonds as may be issued, in accordance with the law of the
City of Paducah and charter of cities of the second class of the State of
Kentucky, and for the payment of which said tax bills and assessments may
be pledged by the said City.of Paducah; and in no event shall the said
City of Paducah be liable to the contractor for the construction of any of
the work herein provided for, extent the said City of Paducah shall be
liable to the said contractor for the excess of fifty (50o) per cent. of
the value of any property assessed for the construction of the work herein
provided for.
SECTION 5.
The contractor awarded the contract herein provided for shall
be paid monthly by Improvement ',7arrants, issued by the City of Paducah
upon estimates furnished by the Commissioner of Public ';forks, to the ex-
tent of sixty-five (65%) per cent. of the value of the work done or mater-
ials furnished by the contractor during the progress of the work, and said
Improvement Warrants shall bear six (60) per cent. interest from date of
issual and shall be issued by the Commissioner of Public Finance upon order
of the Board of Commissioners. Said Improvemenb Parrants shall be nego-
tiable, and shall constitute a lien upon the local taxes to be hereafter
levied for such improvement, and shall be payable at the office of the
Commissioner of Public Finance, without notice to the holder thereof,
upon completion and acceptance of the work herein provided for, out of the
first collection of such local taxes, or out of the proceeds of the sale of
any Improvement Bonds issued in anticipation of such local taxes. The
interest on such Improvement '!axrants shall be estimated and assessed as
a part of the cost of the improvement herein provided for.
SECTION 6.
This Ordinance shall take effect and be in force ten (10) dans
after same is adopted and recorded; provided petition, according to law,
for a referendum vote hereon, has not been filed within said -ten days.
