AN ORDINANCE PROVIDING FOR THE RECONSTRUCTION OP THE DRIVE-
JAYS ON BOTH SIDES OF IAURRELL BLVD. FROM THE SOUTH PROPERTY LINE OF

BE IT ORDAINED BY THE BOARD OF COI.L;iISSIOhERS OF THE CITY OF i

PADUCAH, KENTUCKY:
SECTION 1.
The the driveways on both sides of Murrell Blvd. from the
South property line of Broadway to the South property line of Caldwell
Street, and from the lJest property line of F;iurrell Blvd. on Caldwell
Street, West on Caldwell Street to the East property line of Twelfth
Street, in the City of Paducah, Kentucky, be, and the same is hereby
ordered to be reconstructed; that said street shall be reconstructed
with concrete, tarvia or Kentucky Rock Asphalt, as may be determined by
the Board. of Commissioners as the best and most economical hereafter,
upon bids made therefor, end all to be done in strict accordance with
the plans, grades, specifications, widths and profiles of the Commis- I
sioner of Public ';forks, prepared b;r him for such purpose, 8.11 of Vhich
are adopted as a part of this Ordinance as fully as if embraced herein
or attached hereto and made a part hereof, and marked "A" for more

specific identification.
SECTION 2.
That said work shall be constructed under the direction and
supervision of the Commissioner of Public Works, and shall be commenced,
at a time designated by contract for the -performance of said work, and
completed on or before seven months after the passage and recording of
this Ordinance.
SECTION 3. II
That the cost of such construction of said streets shall be
paid for wholly by the property owners abutting or fronting thereon,
on both sides thereof, to be apportioned to and assessed against -the
property and Property owners abutting thereon, on both sides thereof,
according to the number of front feet abutting thereon, exce-ot that the
City of Paducah shall pay such portion of such costs Of construction as
required by law.
SECTION 4.
The contractor awarded the contract for the work herein pro-
vided for shall be paid only from the funds arisir}S from the Special
Tag bills and assessments against the property abutting the improvement',
herein lw ovided for, and in no other way,- except that the said con-
tractor may be paid out of such bonds as may be issued, in accordance

with the law of the City of Paducah and charter of cities of the second
class of the State of Kentucky, and for the payment of which said tax bills
and assessments may be pledged by said City of Paducah; and in no event
shall the said City of Paducah be liable to the contractor for the con-
struction of any of the work heroin provided for, except that the said
City of Paducah shall be liable be the said contractor for the excess of-

fFifty (50%) per cent of the value of any property assessed for the con-
struction of the work herein provided for.
SECTION 5.
The contractor awarded the contract herein provided for shall be
paid monthly by Improvement ,Iarrants, issued by the City of Paducah upon
estimates furnished by the Commissioner of Public :forks to the extent of
Sixty-five (65%) per cent of the value of the work done or materials fur-
nished by the contractor during the progress of the work, and said Improve-
ment !'Warrants shall bear six (6%) per cent interest from date of issual
and shall be issued by the Commissioner of Public Finance upon order of
the Board of Commissioners. Said Improvement Yarrants shall be negotiable,
and shall constitute a lien upon the local taxes to be hereafter levied for
such improvement, and shall be payable at th^ office of the Commissioner of
Public Finance, without notice to the holder thereof, upon completion and
acceptance of the work_ herein provided for, out of the first collection of
such local taxes, or out of the proceeds of the sale of any Improvement
Bonds issued in anticipation of such local taxes. The interest on such
Improvement Warrants shall be estimated and assessed as a part of the
cost of the improvement herein provided for.
SECTION 6.
Bids shall be received for the construction of said work out of
concrete, tarvia, or Kentucky Rock Asphalt, accord -in to plans and specifi-
cations made and provided therefor by the Commissioner of Public i'Wor'_cs,
and -reported to -the Board of Commissioners at the next -regular or called
meeting, and said Board of Commissioners shall determine the material with
which said street shall be constructed, and award the contract therefor to
the lowest a.nd best bidder, except the right is ex7oressly reserved to re-
ject any and all bids within the discretion of said Board of Commissioners.
SECTION 7.
This Ordinance shall take effect and be in force ten (10) days
after same is adopted and recorded; provided petition, according to la
for a referendum vote hereon has not been filed within said ten days.
