HomeMy WebLinkAboutOrdinances Book 7, Page 573, No Ordinance NumberAN ORDINANCE PROVIDING PO's THE RECONSTRUCTION OF THE DRIVEWAY ON i NORTH SECOND STREET, FROU THE NORTH PROPERTY LINE OF JEFFERSON STREET TO THE SOUTH PROPERTY LINE OF LIOMOE STREET, IN THE CITY OF PADUCAH, KENTUCKY, AT T_,I ; COST OF THE ABUTTING PROPERTY HOLDERS, AND PROVIDING THAT SAID Ili- PROVEI:iEPIT SHALL BE !,VLDE UPON THE TEN YEAR PAYLI NT PLAN. BE IT ORDAINED BY THE BOARD OF CM.111ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION I. That the driveway on North Second Street, from the North property line of Jefferson Street to the South property line of 1.1onroe Street, in the City of Paducah, Kentucky, be, and the same is hereby ordered to be reconstructed; that said street shall be reconstructed with concrete, tarvia or Kentucky Rock. Asphalt, as may be determined by the Board of Commissioners as -the best and most economical hereafter, upon bids made therefor, and all to be done in strict accordance with the plans, grades, specifications, widths and profiles of the Commissioner of Public 'ldorks, prepared by him for such purpose, all of which are adopted as a »rt of this Ordinance as fully as if embraced herein or attached hereto and made. a part hereof, and marked "A" for more specific identification. SECTION 2. That said wor, shall be constructed under 'the direction and super- vision of the Commissioner of Public ';forks, and shall be commenced at a time designated by contract for the performance of said work, and com- pleted on or before seven months after the passage and recording of this i ordinance. s6� No. -6 7 / Ordinance No. SECTIOIJ 3. That the cost of such construction of said street shall be paid for wholly by the property owners abutting or fronting thereon, on both I sides thereof, to be apportioned to and assessed against the property and property owners abutting thereon, on both sides thereof according to the number of front feet abutting thereon, except that the City of Paducah shall Jay such portion of such costs of construction as required by law. SECTION 4. The contractor awarded the contract for the work herein provided for shall be paid only from the funds arising from the Special Tax bills, and assessments against the property abutting the improvement herein provided for, and in no other way,- except that the said contractor may be pp -id out of such bonds as may be issued, in accordance with the law of the City of Paducah and charter of cities of the second class of the State of Kentucky, and for the payment of which said tax bills and assessments may be pledged by said City of Paducah; and in no event shall the said City of Paducah be liable to the contractor for the con -;I struction of any of the work herein provided for, except that the said- City aidCity of Paducah shall be liable to the said contractor for the excess of I Fifty (50%) per cent of the value of any property assessed for the con -I struction of the work herein provided for. SECTION 5. The contractor awarded the contract herein provided for shall be paid monthly by Improvement warrants, issued by the City of Paducah upon i estimates furnished by the Commissioner of Public ',.".forks to the extent of Sixty-five (65%) per cent of the value of the work done or materials furnished by the contractor during the progress of the work, and said Improvement warrants shall bear six (6f) per cent interest from date of issual and shall be issued by the Commissioner.of Public Finance upon order of the Board of Commissioners. Said Improvement 'ilarrants shall be negotiable, and shall constitute a lien upon the local taxes to be here' after levied for such improvement, and shall be payable at the office of the Commissioner of Public Finance, without notice to the holder there- of, upon completion and acceptance of the work herein provided for, out j of the first collection of such local 'taxes, or out of the proceeds of j the sale of any, Improvement Bonds issued in anticipation of such local I taxes. The interest on such Improvement Warrants shall be estimated and assessed as a part of the cost of the improvement herein provided for. SECTION 6. Bids shall be received for the construction of said work out of concrete, tarvia or Kentucky Rock Asphalt, accordiro• to plans and speci= fications made and provided therefor by the Commissioner of Public l7ork�, and reported to the Board of Comiissioners at the next regular or called No. • 6 lJ - Ordinance No.__ _. meeting, and said Board of Commissioners shall determine the material with which said street shall be constructed, and award the contract therefor to the lowest and best bidder, exce-ot the right is expressly reserved to re- ject any and all bids, within the discretion of said Board of Commissioners. SECTIOIQ 7. This Ordinance shall take effect and be in force ten (10) days after same is adopted and recorded; provided petition, according to law, for a referendum vote hereon has not been filed within said ten days.
