VJHEREAS, at a regular meeting of the Board of Commissioners of the
City of Paducah held on I;Iay 13, 1918 a staterrent of facts was agreed to by
said Board of Commissioners as to the facts concerning the referendum
Petition filed, protesting against an ordinance permitting the Paducah
Traction Company to -raise the street car fares from 5 cents to 7 cents; and,
V=REAS, said statement contains in clause 5 the folloaring words,
to -wit:
"But that after the withdravials are taken from
said petition, vie find that said petition does not contain
a number of votes equal to at least 25 per centum of the
total number of votes cast fo-r both candidates for mayor
at the preceding rc_-ulax election for mayor, as required
by statute."
And, i1LREl_S, said words in clause 5 may not express the sense
and understanding of the Board of Commissioners when said statement eras
adopted; noir, therefore,
BE IT RESOLVED BY THE BOARD OF COI.7.=ISSIOITERS OF THE CITY OF
PADUC_1H, KE-14TUCKY:
That the folio,aing vrords appearing in said section 5: "But that
after the withdrawals are taken from said petition," be, and they are
hereby stricken from said section, and_ the folloviing words substituted in
lieu thereof: "But if said withdrawals are permitted to be taken from said
petition," axil that the following words be added to said Section 5 of said
Resolution of i::ay 13, 1918:
"As to the riSht of therotestinr
p petitioners to
withdraw their names from the protesting petition vie do not
pass thereon, but leave this question for tr_e courts to decide."
so that said Section vhhen so amended shall read as Follows, to -wit:
(5) `3e find that after deducting names of all persons of
were not eligible to sign said petitions, and other irregular signatures
from said petitions, that same before any withdrawals were made thereto
had a sufficient number of voters to require action�as prayed in the
petition, but if .the withdrawals are permitted to be taken fro said
petitions, vie find that said petition does not contain a inLnber of voters
equal to at least; 25 per centum of the total number of votes cast for

both candidates for Mayor at the last Preceding regular election for
mayor, as required by Statute. As to the right of the protesting
petitioners to withdraw their names from the protesting petition we do
not pass thereon, but leave this question for the courts to decide.
Section 2. This Resolution shall take effect Land be in
force from and after its passage and record.
