l'iHE_REiS, by reason of the fact that various streets in the City of
Paducah, I.entucky will, at times hereafter, be improved by the laying and

i, t construction of permanent pavements, and there having heretofore been
placed in and under said streets water pipes for the transmission of water
from point to point, both direct and by connection, and a number of said
pipes now being defective by reason of age or defective or insufficient
material- now, therefore, for the purpose of protecting the public
interest -
BE IT ORDLIEaD BY TLE BOiLRD OF Cui.1..ISSIOIIERS OF THE
CITY OF PbDUCAH, KENTUCKY:
Section 1. That any water company supplying water to the City of Paducah
or to any of the citizens thereof under a public franchise shall renew or
replace, at -its own expense, any service pipes extending from the water
mains of such company to the property lines of the water consumers taking
water from such company, upon ten days notice to do so from the Commissioner
of Public Works of the City of Paducah, and in so renewing or replacing
any such pipes such 'later Company is required to use either lead pipe or
galvanized iron pipe for such service lines- and upon a failure of such
water company to renes, or replace such pipes, when so notified as herein-
above specified, such mater Company shall be guilty of a misdemeanor, and,
upon a. conviction, shall be fined Five(ti5.00) Dollars for each day said
water company fails or refuses to comply with said notice- and prosecution
under this ordinance shall be maintained in the Police Court of the City
of Paducah.
Section 2. Provided, however, that the Commissioner of Public Works
shall not give such notice except in the case of service pipes in and
under streets to be paved with permanent or so-called permanent pavement,
and, -further, provided that before the Commissioner of Public Works shall
require any renewal or replacement hereunder he shall make a reasonable
investigation and shall not require the renewal or replacement of any
such service pipe unless his investigation shall show that the pipe to be
replaced or renewed is not, by reason of its age or defective condition
or insufficient material used in its construction, calculated to wear or
last as long as the pavement or pavement foundation about to be laid.
Section 3. This ordinance shall apply to all street improvements already
contracted for but not yet completed, as well as to all street improve-
ments that shall be authorized and contracted for hereafter.

Section 4. This ordinance shall take effect and be in force from
and after its passage, :record and publication.
Section 5. L11 ordinances and parts of ordinances in conflict with
this ordinance are hereby repealed.
