HomeMy WebLinkAboutOrdinances Book 7, Page 266, Ordinance Number 94No.� Ordinance No. AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH SIDES OF FOURTH STREET)FROM THE NORTH PROPERTY LINE OF,'MONROE STREET )TO THE SOUTH CURB LINE OF SLAY STREET,)IN THE CITY OF PADUCAH, KENTUCKY, THE SUM OF $1.812824 PER FRONT FOOT FOR THE COST OF CONSTRUCTION OF CONCRETE SIDE- �IYALKS AND GUTTERS, TOGETHER CiITH GRABITE CURBING AND ALL SEWERS, MANHOLE S, INTAKES, CATCH BASINS AND DRIVE -WAYS IN SAID CONSTRUCTION, EXCEPT THAT PORTION PAID BY THE CITY OF PAdUCAH, AND PROVIDING THAT SAID ASSESSMENT MAY BE PAID IN TEN (10) EQUAL INSTALLMENTS, ONE EVERY YEAR FOR A PERIOD OF TEN YEARS. WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, has heretofore, to -wit: on the 22d day of May 1916, adopted an ordinance entitled: AN ORDINANCE PROVIDING FOR THE CONSTRUCTION OF SIDEWALKS, CURBS AND GUTTERS, AND ALL NECESSARY MANHOLE'S, INTAKES, CATCH BASINS AND SEWERS, ON BOTH SIDES OF FOURTH STREET FROM THE NORTH PROPERTY LINE OF MONROE STREET TO THE SOUTH CURB LINE OF CLAY STREET, IN THE CITY OF PADUCAH, KENTUCKY, AND PROVIDII4G FURTHER THAT THE COST THEREOF I:4AY BE PAID UPON THE TEN YEuR PAYI.T:NT PLAN , and WHEREAS, in accordance with said ordinance it was provided that the cost of the construction of said sidewalks, curbs, gutters, sewers, intakes, manholes and catch basins shall be paid for by the abutting property owners on both sides of said street, except that portion to be paid by the City of Paducah, as required by law; and, WHEREAS, pursuant to said ordinance, a contract was entered into by and between Prosser & Halliday, of the city of Cairo, State of Illinois, and the said City of Paducah, for the construction thereof, on the 15th day of September 1916; and, WHEREAS, said contract has been completed in all respects, and the work thereof finished and accepted by the Board of Commissioners of the City of Paducah, on the 14" day of December 1916, pursuant to recommenda- tion made therefor by the Commissioner of Public Works of the City of Paducah; now, therefore, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: Section 1. That all of the property on both sides of Fourth street from the North property line of Monroe street to the South curb line of Clay street, in the City of Paducah, be end the sane is hereby assessed the sum of p1.812824 per front foot for the cost of construction - of said sidewalks, curbs, gutters, sewers, manholes, i4takes, catch AIRL basins and drive -ways. Section 2. That all of the funds derived from the assessment of said property aforesaid shall be used for the purpose of paying off the Special tax bills issued against said property or such bonds as may No. ✓ l '/ Ordinance No. be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes. Section 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted by an Act of the General Assembly of the Commonwealth of Kentucky of 1910, entitled "AN ACT TO AMEND AND RE-ENACT SECTIONS 3094, 3096, 3097, 3098, 3099, 3100, 3101 and 3102 FF THE KENTUCKY STATUTES, RELATING TO THE CONTROL A14D IMPROV-0.1ENT OF STREETS, PUBLIC WAYS, LAN DINGS, WHARVES, GROUNDS AND SIDEWALKS IN CITIES OF THE SECOND CLASS", said assessments may be- at the option of the property owners- payable in cash within thirty (30) days from the date of the passage and recording of this Ordinance, or in ten (10) annual installments, pursuant to the provisions of said Statute. Section 4. In order to provide a fund for the immediate payment of the cost of that portion of the Special assessments herein provided for, which are to be paid on the installment -payment -plan, as hereinbefore provided for, the City of Paducah shall issue and sell Improvement Bonds, and to secure the payment of which bonds there is hereby pledged such taxes and liens on the property assessed herein for the payment of the principal and interest on such bonds, but such bonds shall not be sold for less than par, and the proceeds thereof applied exclusively to payment for the improvement of said sidewalks, curbs, gutters, manholes, catch basins, intakes and sewers as hereinbefore men- tioned, and such bonds shall be issued and shall bear interest, and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes as amended and re-enacted by the General Assembly of the Commonwealth of Kentucky for 1910, and contained in said Act hereinbefore mentioned. Section 5. This Ordinance shall take effect and be in force from its passage and the recording of some. Passed by the Board of Commissioners Dec. 14, 1916. Recorded by H. D.
