SOUTH PROPERTY LINE E' P OF BROADWAY TO THI: SOUTH PROP12TY LIVE OF MINES= STREET, IN T112 CITY ti. l OF I'ADUCAH, KEN`.i'UCKY, ,This' SUT:i OF $.77 PER ABUTTING FOOT FOR THE CON- �� STRUCTION OF SAID STREET l7ITH CONG ETE, AS SHOWN BY THS; ENGITTEIIR'S ESTIl'.?ATE, E`CCEPT THAT PORTION TO BE PAID FOR BY THi; CITY OF PADUCAH, i KENTUCKY, AND PROVIDING THAT SAID ASSESSIM-11T 1:11Y B:; PAID FOR IN TEII EQUAL INSTnLLi.'_ENTS, BEING ONE EACH YEAR FOR A PERIOD OF T.IT Yi:ARS. ;JHEREAS, The Board of Commissioners of the City of Taducah, Kentucky, has heretofore, to -suit: on the 14th day of May, 1923, adopted an ordinance entitled, "All ORDINANCE PROVIDING FOR THE CONSTRUCTION OF THE DRIVEWAYS, TOGETHER WITH I,LL N sCESSARY I: tNHOLES, CATCH BASINTTS, IN- TAKES AIM SEWER PIPE CONVECTIONS ON SOUTH TENTH STREET, OR IrURRELL BOULEVARD, FROM: THE SOUTH PROPERTY LINE OF BROADWAY TO THE SOUTH PRO- PERTY LINT: OF TENNESSEE STR EET, IN THE CITY OF PADUCAH, =NTUCKY, AT TFL`': COST OF THE ABUTTING PROF!s_RTY OVINERS, AND PP,OVID ING THAT SnI SHALL BE CONSTRUCTED UPON THE TEN YTVR PAYMENT NT PL IQ," and, ;'IIEREkS, in accordance with said Ordinance, it was provided that the cost of the construction of said street shall be paid for by the abutting property owners, except that portion to be paid for by the City of Paducah, as required by law; and, ;'lHPR 115, Pursuant to said Ordinance, a contract was entered in- to by and between Yancy & Johnson, Contractors, of Paducah, Kentincky, and the City of Paducah, Kentucky, for the construction thereof; and, VEREAS, said contract has been completed, in all respects, and the work thereof finished and accepted by the Board of Commissioners of the City of Paducah, Kentucky, on the 12th day of November, 1923, pursu- ant to the recommendation male therefor by the Commissioner of Public .7orks; and the .Engineer's estimate of the cost thereof having been con- firmed; now, therefore - BE IT ORDAINED BY THE BOARD OF COMMISSION};RS OF THE CITY OF PADUCAH , KEN TUCKY: SECTION 1. That all of the property on both sides of South Tenth Street, or Murrell Boulevard, from the south property line of Broadway to the south property line of Tennessee Street, in the City of Paducah, Ken- tucky, be, and the same is hereby assessed for the cost of construction of said street the sum of 4'�?5.77 per abuttinp- foot by pavinP same with concrete, as is shown by the Eng'ineer's ?stimate. S 'CTION 2. That all of the funds derivod From the assessment of said pro- perty aforesaid, shall be used for the purlsose of paying off the speci.a'. Max bills issued against said property, or such bonds as may be issued Ordinance No. Il by the City of Paducah, pursuant to Section 3201 0£ the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, said assess- (ment may be, at the option of the property owners, payable in cash within thirty (30) days from the publication of this Ordinance, or in ten ennual linstallments, as provided in said section:. SECTIOid 4. In order to provide a fund for the immediate payment of the cost of that portion of the said assessment which may be paid on the Ten Year i Payment Plan, the City of Paducah may issue and sell Improvement Bonds; and i to secure the payment of said bonds, there is hereby pledged such taxes and' liens on the property assessed 'herein for the payment of the principal and interest, but such bonds shall not be sold for less than par and accrued interest, and the proceeds thereof applied exclusively in payment of the improvement hereinbefore mentioned, and such bonds, if issued, shall bear interest and shall be payable in accordance :vith the provisions of Sec- tions 3101 and 3102 of the Kentucky Statutes.
