WHEREAS,the General Council of the City of Paducah, kentucky, has heretofore,
to -wit: -September. 9th, 1909, adopted an ordinance entityed,"An Ordinance
Providing for the construction of sidewalks, curbs L,id k,ztter.s, -ndthe.
necessary sewers, manholes, intakes, and catch basins on both sides of Foun-
tain Avenue, or Seventeenth Street, from a point where same intersects the
North curb line of Monroe Street to a point where same intersects the Circle
around. Lang Park; thence ,around said Circle and out Fountain Avenue, or
Seventeenth street, to a point where same intersects the South curb line of
Trimble Street, in the City -of, Paducah, Kentucky;" and,
Whereas, in accordance -with said ordinance it was provided that, the said cost
of construction of said sidewalks, curbs, gutters, sewers, intakes, Manholes
and catch basins, should be paid fwr-by
and, the abutting property holders on Doth
sides of Laid spreet, except the intersections of streets and. public alleys;
Whereas, in pursuance thereof a contract was entered into between A.,J_Miller
& Son and the City of Paducah for the construction thereof; and,
Whereas, said contract has been completed and the work thereof finished and
accepted by the General Council of the City of Paducah according to law; now
therefore,
Be it ordained by the General Council of the City of •'aduca!, K entuay:
Sec;l.That all of the property on both sides of Fountain Avenue from i point
where same intersects the .North curb line of Monroe Street to a point where
same intersects the iouth curb line of Trimble Street, or the Hinkleville
Road, -is hereby assessed the sum of ;'1,723259 ner front foot, for the cost
of construction of said sidewalks, curbs, utters, sewers, manholes,- intakes,
catch basins, and driveways.
Sec2.That ill of the funds derived from the assessment of said property, is
aforesaid, shall be used for the purpose of paying off the special tax bills
issued against said property, and for the cost of construction of said 'Anrk,
Sec -3. That pursuant to Section 3101 of the Kehtuuky statutes, as amended and
re-enacted by an act of the Beneral Assembly of the Commonwealth of Kentucky,
for 1910, entitled, " An Act to amend and Re-enact Sections 3094,.:3094, 3097,
3099, 3099, 3100, 31.01, and 3102 of the Kentucky Statutes, relating to the
control end improvement of streets, public ways, landings, wharves, grounds
and sidewalks in cities of the second class", -said assessments -iay, at the
option of ;.he property owners, be Payable in cash, without intrest, w; tliin
thirty (30) days from the date of the passal;e,•approval and pubLication of
this ordinance, or in ten (10) annual installments, purs-iant to the pro-
visions of said section.
Sec.4. In order to provide a fiend for the immediate payment of L, e cost of
that portion of the special assessments herein provided for, and which are t)
be )aid upon the installment payment plan, as hereinbefore provided for,-
the General Council shell issue and sell Improvement Bonds in anticipation of
the collection of said special tax bills whi6h are to be paid upon the instal
.merit payment plan, and to secure the payment of which bonds there is hereby
pledged•such taxes and liens on the property for the payment of the principal
and interest of such bonds, and such bonds shall be sold for not less than
par, and the proceeds thereof applied exclusively to the payment for the
improvement of said sidewalks, curbs and gutters, hereinbefore mentioned, and
such bonds shall be issued in accordance with, and shall bear interest in.

Sec.5. This ordinance shall take effect and be in force from and after its
passage, approval and publication.
