HomeMy WebLinkAboutOrdinances Book 6, Page 62, No Ordinance Number12 trot a emenof t Oak An ordinance providing for the con end mang Grove c mete ry, and any addition, or additions thereto, and the here I app or keeper ,Council of the City of paduali, appointing of a sexton, Be it ordained by the Gen'' al I jKentucky.- Sec, l.- Oak grove Cemetery, andt'ry addition, or additi ons under the control, ark thereto, shall hereafter be management of the joint cemetery committee of the General Council, of the City of Pa`uCah Y,entucky, subject however, to all ordinances, and resolutions of t;,.e General Council, hereafter, reLula.rly enacted, ands Said Cemetery Com- mittee Shall perform the duties prescribed by said General Council in the management, and superintendence of said cemetery, except as he:e%in- efter provided. Sec, 2, Said Cemetery committee s all select and appoint a sexton, T keeper of se.id cemetery, who shall hold l:is apc,intment at 'the will of said coTuittee, but he ma.Y eT any time be removed from his position by said committee from eny cause. Sec, 3. Said committee shall make a report to the General Council in March, June, September, and Decemtr, r, for each year; shovanr; the character and cost of the vx)rk done on the cemetery gnounds, including repairs of buildings, fences, an, other work-, which report shall also conatin a statment of all new work required, and an es'tinate thereof, nut no contract for�nev; work cornevted vita said cemetery shall be made by them exceeding a cost of tvicer.ty five dollars, unless a description, and cost thereof'be firs', submitted to, and approved by the Gob al Council. Sec, 4, No person, compeny, or organization Shall purchase, }u1ve, nold, or own any lot, or part of a lot in said cemet= ry for 'the pur- pose of re -sate, speculation, or sale of single burial places, or se:1i, or transfe r any lot, or part of a lot in said cemetery, unless such transfer shall first be authorized by the General Council, and such transfer :yta11 be made on the cemetery record by the City Clerk Of' the City of padu@ah, Kentucky, nor shall any person, company, or - Pe bury or suffer, o pe rmit any one to be buried on any lot or part of lot in said cemete ry owned T held by him or them for valuable consid eration. Ani person violating any_ atProvision of this section , shall be fined not less than TM1000 nor more , than z�srSp,cJ for each offense, • Sec, 5. No lot or part (:d of in sad cemete ry shall be su ld to any one until a'certificate from the City Clerk aim eseid Shall be obtained, .certifying that such a lot, or part of a lot is vacant. No body shall be buried in said cemetery until a permit therefor shall have 1p en obtains:d from Said Clerk. The sexton of said cemetery shall not dig, or cause to be dug any ?rave in said cemetery until the party desiring the grave dug shall present to the sexton r. certificate from said Clerk that the treasurer's receipt has been received by him for the required amount. And no burial permit shall be issued by said Clerk, except to bona fide owners of such ground., Any person_ violating ar.y provision of this section shall be fined not less than .'.5.00 or more than 1j20.Op fpr eaclj offense. Sec. 6. No uNdertaker shall bury, or permit to be buries) 'the body of any dead person, in or on any lot in said cemetery, otinedm held, or controlled by such undertaker, or by any other person connected with his establi slime nt, or by any person for tree use of such undertaker except members of his own femily, or relatives. The City Clerk shall not issue aNY PERIvEIT TO BURY anY body In violation of this section, and any person violating this section shall be fined not less titan ;25.00 Or more than ft OO .00 d liars for each offense. Sec. 7. Lots Nos. 2S9 to 319 inclusive whe sold, shall be sold to colored persons only, in connection with the placewhere they have heretofore buried their dead. See. S It shall be unlawful for any person to erect, or maintain any caning over any grave, or other place in said cemetery, or ,to enclose any burial lot therein With a fence of any kind more than twelve inches ir. height Any person violatinG ihy provision of this section shall.be findd not less than 65.00 or more than N25.p0 for eaco. of"ense, and each days continuance of tl.e things herein provided shejll constitute E, separate offense. sec. 9.
