HomeMy WebLinkAboutOrdinances Book 4, Page 281, Ordinance Number 99848 Relating g to and Regulating the Market House, and Prescribing Rule Conduct'Thereof, and Penalties Thereunder, Be it Ordained by the Members o/ the Common Council o/ the City o/ Paducah: 1. That Market Street, between Broadway Street and Court Street, the Market House, Market Stands and other improve- ments therein enclosed or which may be hereafter erected therein, shall be known as the Paducah Market, and that said market shall hereafter be used as a marketplace of the city of Paducah, Ky., for the sale and purchase of provisions, vegetables and other articles necessary for the subsistence, comfort and conve- nlence of the inhabitants of said city, subject to the following and such other rules and regulations as may hereafter be adopted by the common council. 2, Said market shall be opened every day in the week, Sundays excepted, and remain open during sunh hours as are herein mentioned. And it shall be the duty of the Market Mas- ter to ring the ball for the opening of the market in Paducah at 6 o'clock a. in. from the 15th dap of October to the 15th day of April; from the 15th day of April to the 15th day of October at 4 o'cloch a• in, And said market shall be kept open each morn - Ing (Sundays excepted) for three hours, and on each Saturday evening from 2 o'clock to 9 o'clock. It shall be the duty of said Market -Master to superintend the market and keep the marketplace thoroughly cleaned and In good order, and to report to the council such repairs, improve- ments and alterations in and about said market -place as he may deem necessary. He shall, at the times fixed by this ordinance, open said market on market days and during market hours be in constant attendance and preserve good order, He shall see that no imposition is practiced upon the seller by the buyer, or upon the buyer by the seller, and he shall have power at all times to order suspicious, idle or disorderly persons away from said market. 4. Itshall be the duty of said Market -Master every morn- ing to examine all meat and other articles exposed fur sale in said market, and if anything should prove unsound, or in any other way unmerchantable, he shall at once report such person offering such articles for sale to the proper officers. He shall see that all butchery keep their benches, blocks and meat hooks clean, 5., It shall not be lawful fur any person to purchase, sell or make any contract or agreement for the purchase ar sale of any meats, vegetables, provisions or other marketing at said market before the opening of the same by the Market Master; nor shall it be lawful for any person to purchase any article at said market during market hours for exportation or reselling; nor shall any person sell or offer for sale at the market any article which such person may have purchased or forestalled at any place while on the way to, or designed or intended for said market; and no arli. No person engaged in' ~_seeing goods, groceries, fruits, vegetables or other merchandise in Paducah shall take any such goods, groceries, fruits, vegeta. .. bles or merchandise to the market -place in Paducah and there sell or offer to sell same; except that regularly licensed butchers may go upon, the market after market hours are over and buy any meats remaining upon the market and sell the same from their regularly licensed stalls in the market -house. It shall be the duty of the Market -Master to observe and report all viola• tions of this: section, and any person violating any of the pro- visions of this section shall be fined not less than $5 nor more than $20 for each offense, 7. It shall be unlawful for any person to sell or offer to sell any article of marketing at the market -place in Paducah outside of the market•bouse unless he is an actual producer of the same, and it shall be unlawful for any person to sell or offer to sell any marketing inside of said market -house without first abtaining license for a stall therein in the manner hereinafter prescribed. 8. It shall be unlawful for any person to purchase, forestall or sell within the city of Paducah any article of marketing de• signed for the Paducah market before the same shall have been offered for sale at the marketplace in said city during market hours. Provided: the producer of any article of marketing may sell the same to any person for the immediate consumption of such person or his family before the same is offered for sale at the market -place. Any person employing ur using the stalls In violation of sec. tion 7 of this ordinance shall be fined not less than $5 nor more than $10 for each day he shell occupy same, and for any other violation of said section or of this section the person so offending shall be fined not less than $3 nor more than $10. 9, That the market stalls in the market -house shall be numbered as follows: On the northeast side beginning with numbers 1, 8, 5, 7, 9, 11, 18, 15, 17, 19, 21 and 28; and on the southwest side, num. bers 2, 4, 8, 8, 10, 12, 14, 10, 18, 20, 22 and 24. The prices for license for said stalls shall be as follows: Stalls Nos. 1, 2, 28 and 24, $100 per annum. Nos. 11, 12, 18 and 14, $125 per annum and all other numbers shall be $75 per annum. Any person desiring to obtain a license for any of said stalls shall first pay to the treasurer of the city of Paducah the amount required as above fixed and present his receipt therefor to the council clerk, who shall issue to the applicant a license. But the applicant may ob. tain such license for only six months by paying to the treasurer one-half of the amount required for a license for one year. 10. It shall bo the duty' of the Market -Master to properly number the three rows of benches at both ends of the enclosure of the market -house and rent out the same at the following prices and in the following manner: The outside benches that are twelve feet In length shall be rented at the rate of $40 per annum for each bench, and to two different persons; and those of shorter length than twelve feet shall be rented to one person at the rate of $3.33 per foot in length. The inside row of benches at each end of the market -house shall be, rented at the rate of $50 per annum and to two separate persons. But when any of said benches are not occupied by the lessees thereof any farmer marketer may occupy and use the same free of charge. The three benches at the south end on the east side of the market -house, known as Nos. 20, 21 and 22 are set aside for fish market -benches and shall be rented for that purpose only. 11. But no fuel other than charcoal shall be used in such stove. Any per- son who violates this section of this ordinance shall be flood not less than $5 nor more than $10 for each offense. 12. No person shall construct or keep in said markatbouse any wooden or plank floors, unless the same be laid in cement mortar, or with concrete foundations covering the entire under surface. Any floor in said marketplace which does -not conform to this section shall be removed in five days after notice from the Market Master to do so. Any person who violates the provisions Of this section shall be fined not less than $5 no more than $20 for each offense. 13. It shall be unlawful for any erson to weigh any live stock, hides or fish on the public scales in said market -house, and any person violating this section shall be fined not less than $2 nor more than $10 for each offense. 14. All owners or proprietors of lunch stands In said market - house shall close their stands at 10 o'clock a. in each day except Saturdays, when they may remain open during market hours each evening. Any person violating this section shall be fined 55 for each offense. 15. It shall be unlawful for any person to clean, gut or skin any fish on any market bench or elsewhere in said marketplace. Any person who violates this section shall be fined not less than $10 nor more than $25 for each offense. 10. It shall be unlawful for any person to sit or lie on any of the market benches in the market -house or on the market square- Any person violating this sectiohn shall be tined not less than $5 nor more than 110 for each offense. 17. It shall be unlawful for any person coming to market for the purpose ofselling meats, vegetables or products of any kind, or far any other purpose, to leave his horse, mule or other animal bitched or attached to any wagon or other vehicle at the market - house or on the market square during market hours. Any such horse, mule or other animal, when unhitched from wagon or vehicle on the market square shall be immediately removed from the m,rket, square. and not permitted to remain on said square { during market hours. The provisions of section 7 of this ordinance shall not apply to persons bringing to market meats, vegetables or other marketing for their nlegbors, or other families or producers, for accommodation; nor to country merchants having a local place of business, where they sell merchandise and take in exchange therefor meats, vegetables and other marketing. 21, Corn, wheat, hay, .:oats, barley, rye, fodder, shucks, straw, live stock of any kind, fruits and melons are not required to be exposed for sale at the market place, or at any particular time during the day. 22. Citizens, for their family, use, may purchase of any kind of marketing In a reasonable quantity at the market -house, and when an article will admit of di*iston the Market -Master shall, cause the vindor to divide such article amongst any two or more, persons present desiring to purchase, in such manner as he meg deem proper. 23. No person shall be allowed to feed any team on said mar- ket square, nor make any !!,tar, nor dcpcait -uy ga.L.b nlih, melon rinds or other trash in or upon said market square or place from Broadway to Washington Street. 2.1. It shall not be lawful for any person to allow his vehicle- of ehicleof any kind to stand in the street or spaces in front of or around said market house during market hours, except such as. may be employed in bringing provisions and other articles to and from said market; and these, while they remain at said market. shall be under the direction of the market master, and shall be arranged, as he may direct, by the person having charge thereof. - 25. No dog shall be allowed to come to said market place during market hours, unless the owner or person having charge of such dog shall tie or otherwise confine it in such a manner as to be out of the way of all g^rsens attendiue the market. 26. No persons except licensed butchers occupying a licensed stall shallsell or offer to sell at said market place a less quantity than one quarter of meat, except sausage, bacon, pickled meat, beads, feet, ears, tongues, backbones, spare ribs, melts, liver$, lights, kidneys, brains and jowls. 27. Any person violating any of the provisions of this ordin- ance shall, where not otherwise provided, be fined not less than VI nor more than b 10 for each offense. 2n. The term "market master" as herein used shall be held to apply to and mean any policeman who may be assigned by the mayor and common council of the city to perform the duties of market -master. 29. All butter sold at the market-houso shall be sold by the pound. and in no other manner. Any person violating this sec- tion shall be fined $5 for each offense. 80. It shall be unlawful for any butcher or other persons to, use any scales other than platform scales in weighing meats or other things at the market -house. Any person violating this Rec- tion shall be fined $5 for each offense. 81. All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed.
