Biven and wife, Estes Lane Florence M. Biven, residing on Estes Lane in McCracken County, outside the corporate i; limits of Paducah, Kentucky, for authority to lay and construct a water line for the 4 purpose of providing water service to the building located on the property of petitioners r be received and filed and that the request in said petition be granted in accordance with the terms set forth therein. It is understood, however, in granting the privilege sought in said petition neither the City of Paducah nor the Commissioners of Water Works shall be obligated to bu said pipe line or any part thereof, and no such obligation shall be contained or be implied hereafter should the territory to be served by the water line to be laid under i the authority herein requested be taken into or made a part of the City of Paducah. It is further understood that the petitioners will subscribe for water service at the rates now or hereafter prescribed for water .service to consumers outside the city limits of Paducah and subject in all respects to the rules and regulations of the Y City of Paducah or its Commissioners of Water Works which may be now in force or here- gr inafter enacted. Adopted on call of the Roll, Yeas, Commissioners Clark, Johnston, Morrow and Mayor Cherry (4). Commissioner Johnston offered motion that the petition. of C. C. Locke, who is th, owner of property on Homewood Avenue and Husbands Road in I~YcCracken County, outside the corporate limits of Paducah, Kentucky, for authority to lay and construct water lines for the purpose of providing water service to the buildings located on the property of petitioners be received and filed and that the request in said petition be granted in accordance with the terms set forth therein. It is understood, however, in granting the privilege sought in said petition neither the City of Paducah nor the Commissioners of Water Works shall be obligated to buy said pipe lines or any part thereof, and no such obligation shall be contained or implied hereafter should the territory to be served by the water line to be laid under the authority herein requested be taken into or made a part of the City of Paducah. It is further understood that the petitioner will subscribe for water service at the rates now or hereafter prescribed for water service to consumers outside the city limits of Paducah and subject in all respects to the rules and regulations of the City of Paducah or its Commissioners of 'later Works which may be now in force or hereinafter enacted. Miller and wife Ann Irero ?tiller, for authority to connect to a privately owned one and one-half inch water pipe line for the purpose of providing water service for domestic purposes to one building on the property of the petitioners be received and filed and that the authorit sought in said petition be granted in accordance with the terms set forth therein. Water Line Mayor Cherry offered motion that the petition of Otto Bechtold and wife, Margaret Rutter St. Bechtold, residing on Rutter Street in McCracken County, outside the corporate limits of Paducah, Kentucky for authority to lay and construct a water line for the purpose of pro- viding water service to the building located on the property of petitioners be received R and filed and that the request in said petition be granted in accordance with the terms s t forth therein. Commissioner Johnston offered motion that the Board of Commissioners approve the sale by the City of Paducah to Ernest Scruggs of Grave No. 90 in Block No. 8 of the Rushing Addition to Oak Grove Cemetery, and that the City Clerk be authorized to execute a deed of conveyance to said cemetery grave. Adopted on call of the Roll, Yeas; Commissioners Clark, Johnston, Morrow and Mayor Cherry (4). Commissioner Morrow offered motion that the Board of Commissioners approve the sale by the City of Paducah to Henriette White of Grave No. 91, in Block No. 8 of the Rushing Addition to Oak Grove Cemetery, and that the City Clerk be authorized to execute a deed of conveyance to said cemetery grave. Adopted on call of the Roll, Yeas, Commissioners Clark, Johnston, Morrow and Mayor Cherry (4). Commissioner Morrow offered motion that the Board of Commissioners receive and file the agreement executed by the City of Paducah and Ohio Oil Company for sale of asphalt to the City of Paducah. Adopted on call of the Roll, Yeas, Commissioners Clark, Johnston, Morrow and Mayor Cherry (4)/ Commissioner Morrow offered the following motion: I move that the City Treasurer be authorized to comply with the provisions of that certain deed of'conveyanc and agreement entered into between the West Kentucky Mausoleum Company and the City of Paducah, Kentucky on the 3rd day of April, 1920, a copy of which deed of conveyance and agreement is attached to and made a part of this motion; that the sum of $589.00 hereto -Pore received as that part of the sale price collected by the City of Paducah fcr curial lots adjoining the building of the lest Kentucky Mausoleum Company and set aside by the City Treasurer as a part of the trust fund required to be created by the torms of said contract be retaihed in said fund and that the City Treasurer be further authorizgi to place to the credit of said fund the amounts hereafter collect•.:, ty said city as its part of the proceeds from the sale of ,aid burial lots until the total of said trust fund shall amount to „3,000.00, and that said trust fund be rctai:r;� and ir.veoted in United State: Treasury bonds for thepurposes provided in and pursuant ya paragr,nh cf sai,! contract which rend as follows: "t2n-) After +, mina, the aforesaid sum of Three Thou arcd (0,CO0.G0) Dul:ars ty t. Board of Commissioners _ City of Nducah I,;av 6 1_052 long as said fund is so held by the City of Paducah, the necessary repairs and upkeep in maintaining said Mausoleum Building shall be made by the City, but in no event shall the City of Paducah be liable for any such expenditures in excess of 4 per centum on sai Three Thousand W,3,000.00) Dollars within any one year; and, if, at any time after said fund has been so set aside and is in the custody of the City, the said West Kentucky 1 Mausoleum Company, its assigns, representatives or successors, shall desire to terminate i said trust and to cause said fund to be withdrawn from the City of Paducah, then the City r i shall, after 30 days notice to it, pay over said Three Thousand ($3,000.00) Dollars at the end of the next succeeding fiscal year to the said West Kentucky Mausoleum Company, its assigns, representatives or successors; and thereupon said City shall be discharged from its trust, and in such event and upon the termination of such trust, the City will then cease to be liable or obligated for any upkeep or repairs to said Mausoleum Buildin . (3rd) The balance of the funds arising from such sale of such cemetery lots aforesaid, after the application of the aforesaid two sums of Three Thousand ($3,000.00) Dollars each, as aforesaid, shall be divided equally between the west Kentucky Mausoleum pp Company and the City of Paducah, and one-half of said fund so divided shall be retained ll by the City, and the other one-half thereof paid over to the said West Kentucky Mausole Company, its assigns, Representatives or successors, such settlements to be made semi- annually on the 30th day of June and 31st of December in each year. Hospital Mayor Cherry offered the following motion: It appearing that the Board of Addition reinburSe Commissioners heretofore authorized thepayment of the bill of James A. Hamilton City '1161.47 Associates in the sum of w1,441.67 for their financial survey and space utilization o; report in connection with theproposed construction of an addition to the Riverside a Hospital, and that said bill include a charge of '�"1tpl61..47 for a financial survey which was made prior to the grant offer of the Housing and Home Finance Agency to cover advance a planning cost, and w26C.20 for a space utilization study which was made after said grant offer cecame final; and It further appearing that the total sun; of :1,441.67 was paid to James A.
