HomeMy WebLinkAboutMinutes Book 21, Page 443, April 18, 1949No. 4h3 IProceedings of Board of Commissioners Cltp of Paducah April 18, 1949 - - At a meeting of the Board of Commissioners held in the Commissioners' Chamber at the City Fall, Paducah, Kentucky, at 9:00 A.M. on April 18, 1949, for the purpose of hearing charges preferred by Victor C. IIobday, the City Manager, against Rulie Preston Elliott, a police officer of the City of Paducah, Mayor Pro Tem, Stuart Johnston presided and upon call of the Roll the following answered to their names: Commissioners Abell, Allen, Hannin and Mayor Pro Tam Johnston (4). / v Referring to the statement of charges preferred against the defendant, Rulie Preston Elliott, Mayor Pro Tem Johnston requested his attorney, Mr. John Driskill to i� advise the board whether the defendant wished to anter ¢ plea of guilty. .The defendant's attorney announced to the board that the defendant pleaded Not Guilty to said charges and filed -slth the Board of Commissioners a General Demurrer to the Statement of Charges together aith a 11otion to Strike certain portions thereof, said iotlon to Strike being filed by the defendant without waiving his Demurrer. The idayor and board of Commissioners having then heard arguments of Counsel upon said pleadings and being sufficiently advised overruled the defendant's Demurrer and Motion to Strike, to which ruling of the court the defendant excepted; whereupon the board proceded to hear the evidence presented upon said charges in behalf of the City Manager and the evidence given by the defendant and the witnesses who appeared in his behalf. The hearing of evidence had not been completed at 5:15 P.!,% and Mayor Pro Tem Johnston announced that the board would adjourn until 7:30 P.M. The Commissioners convened at 7:30 P.M. on April 18, 1949 and the hearing of evidence upon said charges was resumed. At the close of all the evidence at 10:30 P.M.. the commi:sionors retired for their deliberations and discussions. Returning i to the Commission Chamber at 11:45, Commissioner Rannin moved that the Board of Commissioners adopt as its finding of fact and judgment upon charges preferred by Victor C. hobday, the City tanager, against the defendant, Rulie Preston Elliott, the following: "The Board of Commissioners having hoard the evidence upon charges preferred I agaihst the defendant, Rulie Preston Elliott, by Victor C. Robday, the City I Manager, and being sufficiently advised finds that the defendant has been guilty of violating Rule (3) of an ordinance adopted by the Loard of Comm- isaionors on January 7, 1947, which rule reads as follows: 'Rule (3) insubordination or disrespect to superior officers, or refusal or failure to obey or execute any command or order viven by a superior officer.' i "it is therefore the judgment of the Board of Commiss loners that the dofendan�_ be and he In hcrety nusponlad from duty in the Police Department for a period of fifteen (15) days, such sun,.onnion to be without pay and effective beginning „crll 19, 1949."
