tory bonds having failed to make settlement upon demand of the said coir7dssioncra
of water works, and there beinv some conflict between the contentions of the sure-
ties of the regular city depositories and the sureties in the depository bonds of
the commissioners of water works, and it being desired that action be commenced
at the earliest pcssible date for the recovery of the deposits for the use and
benefit of the water works, and the commissioners of hater r:orks having authority
to proceed upon their bonds by separate action and to pay the exnenses of their
