At a call meeting of the Board of Commissioners hold in the
Coamnissioners' Chamber in the City Hall Building in the City of Poducah;Kentucky
at 10:00 o'clock A.M. on the 13th day of August, 1931, Mayor Lackey presided
and upon call of the roll the following answered to their names: Commissioners
Bradshaw, Hannin, Nelson and Mayor Lackey, (4).
The Mayor stated reason for call, to -:wit: For the purpose of
considering charges of misconduct in the performance 6f his official duties
preferred against Commissioner Ross Rutter;
Ross Rutter- Mr. Rutter being present, the Mayor announced that Mr. Rutter would
trial of mis-
conduct be excused from voting on any of the pending motions during the present hearing.
Theroup6n, the City Solicitor, VL.V.Eaton, announced that he was ready to proceed
with the introduction of testimony on the hearing of said charges, and
Commissioner Rutter, through his attorneys, W.A.Berry and C.B. Crossland, Sr.,
announced ready for trial. The names of all witnesses present were called and
the witnesses were sworn by Judge Roy Holman, Judge of the Paducah Police Court.
After the introduction of all testimony Judge Vl•A.Berry, or behalf of Commissioner
Rutter, addressed the Board of Commissioners, and City Solicitor, w.V.Eaton,
addressed the board on behalf of the City, and it then being almost twelve
o'clock noon, a recess was taken until three o'clock in the afternoon on this
day.
Pursuant to the recess taken at noon on today, the Board of
Commissioners reconvened at 3:00 o'clock, and upon call of the roll the following
answered to their names: Commissioners Bradshaw, Hannin, Nelson and Mayor
Lackey, (4).
Adjournment" Mayor Lackey offered the following motion: The Mayor and CoTnissioners
having been unable to complete their findings on all the evidence given on the
hearing of charges against Ross Rutter, Commissioner of Public Finance, on today,
I now move that the Board of Commissioners adjourn until 11:00 o'clock A.M.
on tomorrow, Friday, August 14, 1931. Adopted on'call of the roll: Yeas;
Cor.missioners Bradshe^a, Hannin, Nelson and Mnyor Lackey, (4).
