HomeMy WebLinkAbout2002-6-6531M ORDINANCE NO. 2002- 6 - & 53/ AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING DESIGNATION FOR PROPERTIES LOCATED ON/AT 5135 CHARTER OAK DRIVE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on May 20, 2002, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FROM R-1 (LOW DENSITY RESIDENTIAL ZONE) TO M-1 (LIGHT INDUSTRIAL ZONE) FOR PROPERTIES LOCATED ON/AT 5135 CHARTER OAK DRIVE," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of 5135 Charter Oak Drive be, and it is hereby, changed from R-1 (Low Density Residential Zone), to M-1, (Light Industrial Zone), and being more particularly described as follows: Beginning at an iron pin and cap #2105 (found) in the east right-of-way of Charter Oak Drive, said point being 37.50 feet east of the centerline of Charter Oak Drive, and also being the northwest comer of the Golden Eagle Distributing, Inc., property; and Thence N69°58'59" E, 396.18 feet to an iron pin and cap (to be set); and Thence S20°00'32" E, 511.28 feet to an iron pin and cap (to be set), said point being on the north property line of the Overland Development Corporation property; and Thence 78°46'49" W, 21.71 feet along the north property line of the Overland Development Corporation property to an iron pin and cap #2105 (found), said point being the southeast comer of the Golden Eagle Distributing, Inc. property; and Thence N20°00'32" W, 450.06 feet along the east property line of the Golden Eagle Distributing, Inc. property to an iron pin and cap #2105 (found), said point being the northeast corner of the Golden Eagle Distributing, Inc, property; and Thence S78°46'00" W, 379.16 feet along the north property line of the Golden Eagle Distributing, Inc. property back to the point of beginning. Said property containing 21,782 square feet, or 0.500 acre. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on arate days and will become effective upon summary publication pursuant to KRS Chapter 424. r� ATTEST: Tammara S. Brock, Asst.
