ORDINANCE NO. 2002-5-6515
AN ORDINANCE CREATING NEW SECTIONS IN
CHAPTER 14, "ANIMALS", ARTICLE II, "DOGS" OF THE
CODE OF ORDINANCES OF THE CITY OF PADUCAH,
PERTAINING TO THE REGULATION OF NUMBER AND
CONFINEMENT OF DOGS WITHIN THE CITY OF
PADUCAH
WHEREAS, it is the intent of the Board of Commissioners to enact an ordinance
providing for the regulation of the maximum number of dogs allowed per household and/or lot
within the City of Paducah; and
WHEREAS, it is the intent of the Board of Commissioners to enact an ordinance
providing for the regulation of the means for restraining and confining dogs within the City of
Paducah; and
WHEREAS, the Board of Commissioners finds that this Ordinance is necessary
for the safety, security, and welfare of the citizens of Paducah, as well as the dogs confined and
restrained herein; and
WHEREAS, the Board of Commissioners finds that an emergency exists with
respect to the current law as it pertains to the maximum number of allowable dogs per household
and/or lot within the City of Paducah and the means for restraining and confining said dogs.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. A new section shall be created in Chapter 14,
Article II, Section 32, Dogs, of the Paducah Code of Ordinances as follows:
Maximum Number of Dogs Allowed in Each Household or on Each Lot. It shall
be unlawful for anyfamily unit, person or persons to maintain more than three (3) dogs within a
household or on a lot located within the Citylimits of the City of Paducah, McCracken County,
Kentucky at any one time except during times of whelping a litter, and until such time as the
litter attains the age necessary to be safely separated from the female dog, such time not to
exceed ten (10) weeks.
SECTION 2. A New Section. A new section shall be created in Chapter 14,
Article II, Section 33, Dogs, of the Paducah Code of Ordinances as follows:
Chaining and Tethering of Dogs; Authority to Impound. It shall be unlawful to
restrain a dog or Upy by chain or tether for more than one (1) hour in py twenty-four (24)
hour period. Any dog found chained or tethered for more than one (1) hour in any twenty-four
(24) hour period shall be subject to seizure and impoundment by the City.
SECTION 3. A New Section. A new section shall be created in Chapter 14,
Article II, Section 34, Dogs, of the Paducah Code of Ordinances as follows:

Minimum Enclosure Requirements for the Confinement of Dogs. An enclosure to
confine a dog must meet the minimum enclosure requirements as provided herein and must also
be adequately supported so as to achieve the intended strength and prevent the entry of
unauthorized persons into the confined area.
(a) For enclosures consisting substantially of wire, the following
provisions shall apples
( 1) An enclosure to confine a dog that is no taller than twelve
(12) inches must be constructed with no less than sixteen (16)
,gauge wire.
(2) An enclosure to confine a dog that is taller than twelve (12)
inches but no taller than eighteen (18) inches must be constructed
with no less than (12) gauge
(3) An enclosure to confine a dog that is taller than eighteen
18 inches must be constructed with no less than nine (9gauge
wire.
21 Enclosures consisting substantially of wood must be adequately
constructed so as to prevent escape of the dog confined.
Deteriorated and/or inadequate enclosures shall be replaced upon
order of the city's dog warden. Noncompliance shall result in
penalties as set forth in this Article.
SECTION 4. Pursuant to KRS 83A.060, the City Commission suspends the
requirement of a second reading of this ordinance. As grounds therefor, the City Commission
does hereby declare an emergency to exist as to the current status of the maximum number of
allowable dogs within the City, and the means for restraining and confining dogs. This
ordinance shall become effective upon the first reading of this ordinance and publication of
same.
