ORDINANCE NO. 2004-10-6877
AN ORDINANCE APPROVING THE FINAL REPORT OF THE
PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR
PROPERTIES LOCATED AT 1210-1224 BERNHEIM AVENUE, AND AMENDING
THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution passed by the Paducah Planning
Commission on October 4, 2004, and entitled, "A RESOLUTION CONSTITUTING
THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE
PROPOSED ZONING FROM R-3 TO B-3 FOR PROPERTIES LOCATED AT 1210-
1224 BERNHEIM AVENUE," be approved as the final report of said Commission
respecting the matters therein set forth.
SECTION 2. That the zone classification and the map amendment
proposed in said resolution be, and the same are hereby, declared to be in agreement with
the comprehensive plan of the City of Paducah.
SECTION 3. That the zone classification of the following described
property be, and it is hereby, changed from R-3, Medium Density Residential Zone to B-
3, General Business Zone:
Beginning at a point, said point being in the centerline of Bernheim
Avenue; and being 192' in an easterl� direction from the intersection of
the centerlines of KY -305 (North 13 Street) and Bernheim Avenue;
thence in a southerly direction 182' to a point; said point being the
centerline of the 12' alley; thence in an easterly direction 240' to a point;
said point being the centerline of the 12' alley; thence in a northerly
direction 182' to a point; said point being the centerline of Bernheim
Avenue; thence in a westerly direction 240' to the point of beginning.
Said description containing approximately 1.04 acres.
SECTION 4. That if any section, paragraph or provision or provisions of
this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the
deficiency or invalidity of such section, paragraph or provision shall not affect any other
section, paragraph or provision hereof, it being the purpose and intent of this ordinance to
make each and every section, paragraph and provision hereof separable from all other
sections, paragraphs and provisions.
SECTION 5. This ordinance shall be read on two separate days and will
become effective upon summary publication
