HomeMy WebLinkAbout2004-9-6874241 ORDINANCE NO. 2004-9-6874 AN ORDINANCE AMENDING CHAPTER 122, VEHICLES FOR HIRE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Sec. 122-71, "Applicability of Article," of Chapter 122, Vehicles for Hire, of the Code of Ordinances of the City of Paducah, Kentucky, is hereby amended to read as follows: "Sec. 122-71. Applicability of Article. No person shall operate or cause to be operated for hire any vehicle, of whatever nature, drawn by animals for the purpose of transporting passengers or conducting tours Won the public Rights-of-way of the city ^r the Old and Hisser -ie Dis4f etl except animal drawn vehicles as provided in this article." SECTION 2. That Sec. 122-72, "Locations for Picking Up and Discharging Passengers," of Chapter 122, Vehicles for Hire, of the Code of Ordinances of the City of Paducah, Kentucky, is hereby amended to read as follows: "Sec. 122-72. Locations for Picking Up and Discharging Passengers. (b) Animal -drawn vehicles may originate and terminate tours on Broadway within the Carriage Corner area at the intersection of Broadway and Second Street designated for horse/carriage traffic." SECTION 3. That Sec. 122-73, "Route Limitations; Hours of Operations," of Chapter 122, Vehicles for Hire, of the Code of Ordinances of the City of Paducah, Kentucky, is hereby amended to read as follows: "Sec. 122-73. Route Limitations; Hours of Operation. Animal -drawn vehicles may operate on streets or public ways in the city as approved by the City Traffic Commission. Animal -drawn vehicles must operate within certain hours specified by the city unless the operator receives prior written consent from the City Manager." SECTION 4. That Sec. 122-77, "Standards for Vehicles," of Chapter 122, Vehicles for Hire, of the Code of Ordinances of the City of Paducah, Kentucky, is hereby amended to read as follows: "Sec. 122-77. Standards for Vehicles. All animal -drawn vehicles shall be authentically styled passenger carriages which are aesthetically pleasant and comport with the downtown riverfront area. Wagons which patently were designed for cargo instead of passengers will not be approved. All animal -drawn vehicles shall have adequate brakes and shall have adequate front and back lights, which back lights shall include brake hazard lights. All animal -drawn vehicles shall also contain sufficient reflective material to ensure visibility. Each carriage in use shall have a separate and unique identification number prominently displayed on the rear of the carriage. The City Manager is hereby accorded the authority to promulgate such other regulations as to carry out the intent of this article." SECTION 5. That Sec. 122-79, "Permit," of Chapter 122, Vehicles for Hire, of the Code of Ordinances of the City of Paducah, Kentucky, is hereby amended to read as follows: "Sec. 122-79. Permit. (a) An applieai# for- a pefmit shall provide the fellewing.t (a) The city manager shall conduct an open bidding to award a Downtown Horse Carriage Tour Permit for the sole right to operate a horse drawn carriage business within the l downtown area defined by the City Manager and for the sole right to use the carriage corner at Second and Broadway as a passenger pick up and discharge site for a period of three (3) years (1) The winning bidder will be chosen according to the following criteria: a. Display willingness and abilily to comply with all parts of this ordinance b. Possess experience that is necessary to proper horsemanship and the safe operation of a horse carriage in large crowds of people as well as heave automobile traffic c. Demonstrate the ability to provide adequate service to meet customer demands by operating such carriages evga Friday and Saturday night from April through October including special events and festivals which m y occur during this time, weather permitting. d. Present description of different types of tours offered, and the rates to be charged for each type of tour. (b) A separate Contract Carriage Operating Permit will be issued on a temporary basis to operators who have been hired for a specific event (party, wedding, etc.). Such permit shall be issued up to fifteen (15) city business days before such business conducted by the operator shall take place. (1) This permit is valid for only as long as the specified permitted event is occurring (2) An applicant for this permit shall also comply with all part of Section C listed below duringeach ach year in which they apply for this license (3) Applicants must fax or otherwise provide to the City, no later than one (1) full business day prior to the event, a map showing: a. Point of origin b. All roads being traveled before, during, and after the contracted carriage services are performed c. Final destination (4) An applicant for this permit is prohibited from picking LIP or transporting passengers who are not associated with the party contractin for service, or traveling on roads not approved in his Contract Carriage Operating Permit. (5) Applicant must comply with all other parts of this ordinance (6) This permit is open to any operator, provided they comply with all arts of Section C below, including operators who have been awarded a Downtown Horse Carriage Tour Permit (c) Carriage service providers shall also provide the followin a. Adequate identification of the applicant and animal -drawn vehicle and proof of ownership b. Material setting forth characteristics of the vehicle, including its dimensions, and estimated passenger capacity. 243 c. Color photographs not less than eight inehes by ten inehes five inches by seven inches of all four- si of the vehicle or sketches of a similar make and model of the vehicle d. Adequate proof of liability insurance with PIP coverage in the following amounts: i. Not less than $100,000.00 in limited liability in occurrence; ii. Not less than $300,000.00 in public liability per occurrence; iii. Not less than $50,000.00 $250,000.00 for property damage per occurrence; iv. The City of Paducah shall be named as an additional insured; e. Satisfactory proof of health inspections of the animal(s) to be utilized in drawing the vehicle L A fee established by the City A permit fee, in addition to the business license fee. i. $25.00 per year for Downtown Horse Carriage Tour Permit ii. $5.00 per occasion for Contract Carriage Operating Permit, not to exceed a total of $25.00 per year. g. A current city business license h. Evidence of satisfactory annual safety and appearance inspection of tack and equipment, including devices that prevent droppings from being left on city streets; and i. Evidence of compliance with all the standards for vehicles in this article (d) Inspection for compliance shall be performed by the Director of Animal Control, his departmental designee, or other such individual as designated by the Chief of Pell o City Manager. In the event of compliance; the inspector shall certify such compliance to the city T ieense Audite" Finance Director, who shall then issue a permit upon payment of the fee." SECTION 4. That if any section, paragraph or provision of this Ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this Ordinance to make each and every section, paragraph, an provision hereof separable from all other sections, paragraphs and provisions.
