ORDINANCE NO. 2004-7-6849
AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH
PLANNING COMMISSION RESPECTING THE PROPOSED FINAL SUBDIVISION OF
PROPERTY OF FALCONITE & HIPP, LLC LOCATED ON/AT PERKINS CREEK DRIVE,
ACCEPTING THE DEDICATION OF RIGHT-OF-WAY AND PUBLIC EASEMENTS
WHEREAS, the Paducah Planning Commission, at a meeting held on February
2 2004 adopted as a preliminary report a plat of the proposed subdivision of property of
Falconite & Hipp, LLC, for property located on/at Perkins Creek Drive, and by Resolution dated
June 7, 2004, recommended to the Board of Commissioners of the City of Paducah, Kentucky,
the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and
accepting the dedication of right-of-way and public easements shown thereon; and
WHEREAS, the Paducah Planning Commission adopted a revised plat on July
19, 2004, for said subdivision reflecting a change in lot reduction and setbacks and is now
recommending the "Revised Final Subdivision/Final PUD -Plantation Village" be approved by
adoption of an ordinance with said subdivision reflection thereon; and accept the dedication of
right-of-way and public easements shown thereon; and
WHEREAS, the City Engineer has recommended an escrow agreement in the
amount of $155,000 for completion of the public roadway, and all other public improvements,
utilities and infrastructure, including but not limited to grading, drainage, and paving.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution adopted by the Paducah Planning Commission

on July 19, 2004, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE
PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDMSION OF
PROPERTY OF FALCONITE & HIPP, LLC LOCATED ON/AT PERKINS CREEK DRIVE",
be approved as the final report of said Commission respecting the matters set forth therein.
SECTION 2. That the subdivision of said property shall be, and it is hereby,
approved as shown on the plat referred to in said subdivision, which plat is entitled, "Revised
Final Subdivision/Final PUD -Plantation Village", and said property is hereby declared to be
subdivided as shown on said plat.
SECTION 3. That the dedication of the public right-of-way and public utility
easements shown on said plat shall be, and they are hereby, accepted. The Mayor is hereby
authorized to subscribe a certificate of approval on the plat.
SECTION 4. That the Board of Commissioners approves the recommendation
of the City Engineer to accept an escrow agreement in the amount of $155,000 for completion of
the public roadway, and all other public improvements, utilities and infrastructure, including but
not limited to grading, drainage, and paving and authorizes the Mayor to execute said agreement.
SECTION 5. That if any section, paragraph or provision of this ordinance shall
be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of
such section, paragraph or provision hereof, it being the purpose and intent of this ordinance to
make each and every section, paragraph and provision hereof separable from all other sections,
paragraphs and provisions.

SECTION 6. This ordinance shall be read on two separate days and will become
effective upon summary publication according tc
