HomeMy WebLinkAbout2004-7-6848205 ORDINANCE NO. 2004-7-6848 Lying on the Northerly side of Hansen Road and being part of Perkins Creek Drive and all of Lot 12 per Plat of Subdivision (Section A) of Strawberry Hill recorded in Plat Section "U, Page 697, McCracken County Court Clerk's Office, McCracken County, Kentucky, and more particularly bounded and described as follows to wit: Beginning at a point in the Northerly right-of-way line of Hansen Road (25 feet from the centerline thereof) at its intersection with the Easterly right-of-way line of Perkins Creek Drive, said point being at the Southwesterly corner of Lot 14, per Plat of Subdivision (Section B) of Strawberry Hill recorded in Plat Section "L", Page 698, McCracken County Court Clerk's Office; THENCE FROM SAID POINT OF BEGINNING N 810 52' 13" W with the Northerly right-of- way line of said Hansen Road and passing the Southeasterly corner of Lot 12 , per Plat of Subdivision (Section A) of Strawberry Hill recorded in Plat Section "L", Page 697, at 110.12 feet for a total ' distance of 554.40 feet to a point at the Southwesterly corner of said Lot 12 and the Southeasterly corner of the Cornerstone Community Church property per Deed Book 785, Page 800; thence N 30 59' 59" E with the Westerly line of said Lot 12 and the Easterly line of said Cornerstone Community Church property 819.06 feet to a point at the Northwesterly corner of said Lot 12 and Northeasterly corner of said Cornerstone Community Church property, said point also being in the Southerly line of Lot 8 per said Plat of Subdivision (Section A) of Strawberry Hill; thence S 81 ° 22' 48" E with the AN ORDINANCE EXTENDING THE BOUNDARY OF THE CITY OF PADUCAH, KENTUCKY, BY FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS limits, located WHEREAS, a tract of property adjacent to the present city near Perkins Creek Drive and Hansen Road, is urban in character and suitable for development for urban purposes without unreasonable delay; and WHEREAS, the property is contiguous to the present corporate limits of the City, and it is desirable and necessary to annex the hereinafter described property; and WHEREAS, said tract of land is not within the boundary of another incorporated city; and WHEREAS, KRS 81A.420 provides that a city may adopt an ordinance finalizing annexation to the city of the territory described in the previously adopted ordinance declaring its intent to annex said property; and WHEREAS, the City of Paducah declared its intent to annex said property by Ordinance No. 2004-1-6749. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It is the intent of the City of Paducah, Kentucky, to finalize the annexation of the hereinafter described property, and therefore that the hereinafter described property be annexed to, and be made a part of the City of Paducah, Kentucky said real property being more particularly and accurately described as follows: Lying on the Northerly side of Hansen Road and being part of Perkins Creek Drive and all of Lot 12 per Plat of Subdivision (Section A) of Strawberry Hill recorded in Plat Section "U, Page 697, McCracken County Court Clerk's Office, McCracken County, Kentucky, and more particularly bounded and described as follows to wit: Beginning at a point in the Northerly right-of-way line of Hansen Road (25 feet from the centerline thereof) at its intersection with the Easterly right-of-way line of Perkins Creek Drive, said point being at the Southwesterly corner of Lot 14, per Plat of Subdivision (Section B) of Strawberry Hill recorded in Plat Section "L", Page 698, McCracken County Court Clerk's Office; THENCE FROM SAID POINT OF BEGINNING N 810 52' 13" W with the Northerly right-of- way line of said Hansen Road and passing the Southeasterly corner of Lot 12 , per Plat of Subdivision (Section A) of Strawberry Hill recorded in Plat Section "L", Page 697, at 110.12 feet for a total ' distance of 554.40 feet to a point at the Southwesterly corner of said Lot 12 and the Southeasterly corner of the Cornerstone Community Church property per Deed Book 785, Page 800; thence N 30 59' 59" E with the Westerly line of said Lot 12 and the Easterly line of said Cornerstone Community Church property 819.06 feet to a point at the Northwesterly corner of said Lot 12 and Northeasterly corner of said Cornerstone Community Church property, said point also being in the Southerly line of Lot 8 per said Plat of Subdivision (Section A) of Strawberry Hill; thence S 81 ° 22' 48" E with the i 206 Northerly line of said Lot 12 and the Southerly line of said Lot 8, 479.29 feet to a point in the Westerly right-of-way line of aforesaid Perkins Creek Drive at the Northeasterly corner of said Lot 12 and Southeasterly corner of said Lot 8; thence S 810 22' 48" E with the Northerly line, projected Southeastwardly of said Lot 8, 50.14 feet to a point in the Easterly right-of-way line of said Perkins Creek Drive; thence S 40 19' 45" W with the Easterly right-of-way line of said Perkins Creek Drive 784.19 feet to a point; thence S 38° 46' 14" E and continuing with said Easterly right-of-way line 43.82 feet to the point of beginning, and containing 9.862 Acres as shown on "Annexation Plat for Falconite & Hipp, LLC" prepared by Hunter Martin & Associates, Inc. dated December 30, 2003. The above legal description was written by Rod H. Martin, Kentucky Licensed Professional Land Surveyor, on the 30th day of December. 2003, and is correct to the best of my knowledge and belief.
