ORDINANCE NO. 2004-7-6838
AN ORDINANCE AMENDING CH. 110, TRAFFIC AND VEHICLES
OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Sec. 110-281, "Definitions" of Chapter 110, Traffic
and Vehicles, of the Code of Ordinances of the City of Paducah, Kentucky is hereby
amended to read as follows:
"Sec. 110-281. Definitions.
For the purpose of this article, the following definitions shall apply unless
the context clearly indicates or requires a different meaning.
Motor truck. Any motor -propelled vehicle designed for carrying freight or
merchandise or designed and used primarily for pulling semi -trailers or trailers, such as
truck -tractor. It shall not include self-propelled vehicles designed primarily for passenger
transportation, but equipped with frames, racks or bodies having a load capacity of not
exceeding 1,000 pounds.
Semi -trailer. A vehicle designed to be attached to, and having its front
end supported by, a motor truck or truck -tractor, intended for the carrying of freight or
merchandise and having a load capacity over 1,000 pounds.
Trailer. Any vehicle designed to be drawn by a motor truck or truck -
tractor, but supported wholly upon its own wheels, intended for the carrying of freight or
C, merchandise and having a load capacity of over 1,000 pounds."
SECTION 2. That Sec. 110-283, "Operation on Public Ways --Generally"
of Chapter 110, Traffic and Vehicles, of the Code of Ordinances of the City of Paducah,
Kentucky is hereby amended to read as follows:
"Sec. 110-283. Operation on Public Ways.

(a) Except as earessly permitted in this section and section 110-342
(Schedule II) of this Traffic Code no person shall park or operate a motor truck in
conjunction with a semi -trailer or trailer on any street or public way in the City other than
a designated truck route except for the following authorized purposes:
(1) The provision of a necessarygovernmental or public utility
service.
(2) Pickups deliveries service calls which purposes shall be subject to
the following conditions.
a. The operator of the vehicle shall only utilize streets outside
the designated truck route which are necessary for the
pickup, delivery, or service call.

b. The operator of the vehicle shall effectuate the pickup
delivery, or service call in an expeditious manner and shall
return to the designated truck route immediately upon
completion of same.
(b) Except as expressly permitted in this section no person shall park
a motor truck, semi -trailer, or trailer on a designated truck route or, on public or private
property located off a designated truck route which is within a distance of 50' of an
occupied residential dwelling."
SECTION 3. That Sec. 110-291, "Authority of Police to Stop Vehicle to
Determine Compliance” of Chapter 110, Traffic and Vehicles, of the Code of Ordinances
of the City of Paducah, Kentucky is hereby amended to read as follows:
"Sec. 110-291. Authority of Police to Stop Vehicle to Determine
Compliance.
Police officers shall have the authority to perform the following acts:
(a,) Any police officer of the city shall have the right to stop the
operator of any motor truck, semi -trailer or trailer in order to make measurements as to
the length, width, height or weight of the equipment and load and may require the driver
thereof to proceed to a scale to ascertain whether or not the equipment exceeds the
maximum limitations prescribed in this article. The fee for the use of the scale shall be
paid by the operator of the equipment.
b) Any police officer of the city shall also have the right to stop the
operator of any motor truck in order to make a determination as to the operator's
compliance with the provisions under section 110-283.
U In the event a police officer determines that the operator of any
motor truck is in violation of any of the provisions of this Article such officer shall have
the right to issue a citation to the operator for each violation In the event the police
officer has identified a motor truck as being in violation of an of the provision of this
Article but cannot ascertain the owner of the vehicle the police officer shall have the
authority to issue a citation to the registered owner of the vehicle for each violation."
SECTION 4. That Sec. 110-341, "Schedule I: Motor Trucks, Semi -trailers
and Trailers Restricted on Certain Streets," of Chapter 110, Traffic and Vehicles, of the
Code of Ordinances of the City of Paducah, Kentucky is hereby amended to read as
follows:
"Sec. 110-341. Schedule I: Motor Trucks, Semi -trailers and Trailers
Restricted on Certain Streets.
U It shall be unlawful for any person, firm, company or corporation,
at any time between the hours of 8:00 a.m. and 5:30 p.m., seven days per week, to
operate any motor truck of more than a four -ton capacity ^Y *Mek t:Fae " with either a
semi -trailer or trailer attached thereto, as defined in section 110-281, without being
escorted by a police cruiser, upon the following streets in the city:

SECTION 5. That Sec. 110-342, "Schedule H: Truck routes of Chapter
110, Traffic and Vehicles, of the Code of Ordinances of the City of Paducah, Kentucky is
hereby amended to read as follows:
Sec. 110-342. Schedule II: Truck routes.
Motor trucks, semi trailers or trailers may be operated only on the following
described streets and public ways of the city.

SECTION 5. That if any section, paragraph or provision of this Ordinance
shad be found to be inoperative, ineffective or invalid for any cause, the deficiency or
invalidity of such section, paragraph or provision shall not affect any other section,
paragraph or provision hereof, it being the purpose and intent of this Ordinance to make

each and every section, paragraph, an provision hereof separable from all other sections,
paragraphs and provisions.
SECTION 6. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to er 424.
