ORDINANCE NO. 2004-2-6758
AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING
COMMISSION RESPECTING THE PROPOSED FINAL SUBDIVISION OF PROPERTY OF HILL TERRACE
DEVELOPMENT INC LOCATED ON HILL TERRACE, ACCEPTING THE DEDICATION OF RIGHT-OF-
WAY AND PUBLIC EASEMENTS
WHEREAS, the Paducah Planning Commission, at a meeting held on December 17, 2001,
adopted as a preliminary report a plat of the proposed subdivision of property of Hill Terrace Development, Inc.,
for property located on Hill Terrace, and by Resolution dated June 17, 2002, recommended to the Board of
Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said
subdivision reflected thereon, and accepting the dedication of right-of-way and public easements shown thereon.
WHEREAS, the City Engineer has recommended retainage of cash security in the amount of
$5,000 in lieu of a subdivision bond for minor street improvements remaining.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution adopted by the Paducah Planning Commission on June 17, 2002,
entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING
COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY HILL TERRACE DEVELOPMENT,
INC., LOCATED ON HILL TERRACE", be approved as the final report of said Commission respecting the
matters set forth therein.
SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown
on the plat referred to in said subdivision, which plat is entitled, "Subdivision and Right of Way Dedication
Blocks 5 and 12, City of Paducah, Kentucky", and said property is hereby declared to be subdivided as shown on
said plat.
SECTION 3. That the dedication of the public right-of-way and public utility easements shown
on said plat shall be, and they are hereby, accepted. The Mayor is hereby authorized to subscribe a certificate of
approval on the plat.
SECTION 4. That the Board of Commissioners approves the recommendation of the City
Engineer to retain adequate cash security in the amount of $5,000 in lieu of a bond for minor street improvements
remaining.
SECTION 5. That if any section, paragraph or provision of this ordinance shall be found to be
inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or
provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and
provision hereof separable from all other sections, paragraphs and provisions.
SECTION 6. This ordinance shall be read on two
summary publication according to KRS Chapter 424.
