ORDINANCE NO. 2004-3-6777
AN ORDINANCE DEEMING IT NECESSARY TO CONDEMN AND
ACQUIRE FOR PUBLIC PURPOSES CERTAIN REAL ESTATE LOCATED IN
McCRACKEN COUNTY, KENTUCKY, FOR FURTHER AVIATION
DEVELOPMENT OF BARKLEY REGIONAL AIRPORT
WHEREAS, pursuant to the authority granted to a city of the second class
by the Kentucky Constitution, Section 242, and Kentucky Revised Statutes 82.082 and
183.476, the city of Paducah, Kentucky, a city of the second class, together and in
conjunction with the County of McCracken, Kentucky, a political subdivision of said
state, both of whom are the joint owners of a public airport located in McCracken
County, Kentucky, known as Barkley Regional Airport, do hereby deem it necessary to
condemn and acquire for public purposes certain real estate located in McCracken
County, Kentucky, for further aviation development.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That in order to conform with the regulations of the Federal
Aviation Administration, relative to navigation facilities and the safe maintenance of
approaches to Barkley Regional Airport, the City of Paducah, in with McCracken
County, hereby authorizes the condemnation of a tract of real estate located in
McCracken County, Kentucky.
j SECTION 2. That the corporation counsel of the City of Paducah,
Kentucky be, and is hereby authorized and directed to institute condemnation
proceedings in the McCracken Circuit Court in the name of the City of Paducah,
Kentucky, against Gordon Farms, Inc., of the herein -described real property for the
purpose of further aviation development of Barkley Regional Airport.
SECTION 3. That condemnation sought to be acquired is located in
McCracken County, Kentucky, and is more particularly described as follows:
Boundary Description For A 0.421 Acre Lot
Beginning at an iron pin and cap stamped FH&T 1842, said iron pin being the
northwest corner of the above referenced 0.421 acres, said iron pin being 30 feet
measured perpendicularly from a point in the centerline of KY Highway 724
(Fisher Road), said iron pin also being the northwest corner of the property of
Gordon Farms, Inc. as recorded in Deed Book 853, Page 572 (Tract No. 3, Parcel
B) in the office of the County Court Clerk of McCracken County KY; thence
from the point of beginning with the north property line of the above referenced
Gordon Farms, Inc. property South 68°38'21" East, a distance of 20.47 feet to a
point; thence with a new line in a southwesterly direction along an arc turning to
the left, an arc distance of 353.28 feet, said arc having a radius of 580.00 feet,
and said arc being subtended by a chord bearing South 04°46'51" West, a chord
distance of 347.84 feet to a point on the north property line of a one acre tract of
land owned by the City of Paducah and the County of McCracken, Kentucky as
recorded in Deed Book 1077, Page 55 in the office of the County Court Clerk of
McCracken County KY; thence with the north property line of the above
referenced one acre tract North 69029147" West, a distance of 126.23 feet to a
point on the east Right of Way of a five foot wide dedicated Utility tract, said
Utility tract being adjacent to the east line of a 50 foot wide Right of Way of KY
Highway 724, said point also being the northwest property corner of the above
referenced one acre tract; thence along the east Right of Way line of the
dedicated Utility tract North 22°28'09" East, a distance of 335.33 feet to the

point of beginning containing 0.421 acres. All bearings are based on KY State
Plane South, Grid North.
Boundary Description For A 17.857 Acre Lot
Beginning at a point, said point being the northwest corner of the this 17.857 acre
description, said point also being South 22°28'09" West, a distance of 445.21
feet from an iron pin and cap stamped FH&T 1842 said iron pin being the
northwest corner of the Gordon Farms, Inc. property recorded in Deed Book 853,
Page 572 (Tract No. 3, Parcel B), said iron pin being 30 feet measured
perpendicularly from a point in the centerline of KY Highway 724 (Fisher Road);
thence from the point of beginning and with the south property line of a one acre
tract of land known as the McNeil tract owned by the City of Paducah and the
County of McCracken, Kentucky as recorded in Deed Book 1077, Page 55 in the
office of the County Court Clerk of McCracken County KY South 69°29'47"
East, a distance of 223.13 feet to a point; thence with a new line in a
southeasterly direction along an arc turning to the left, an arc distance of 124.37
feet, said arc having a radius of 580.00 feet, and said arc being subtended by a
chord bearing South 33°04'22" East, a chord distance of 124.13 feet to a point;
thence South 38 43'41" East, a distance of 305.41 feet to a point; thence South
43°O1' 15" East, a distance of 2.55 feet to a point, said point being in the west line
of a one acre tract of land known as the Howland tract owned by the City of
Paducah and the County of McCracken, Kentucky as recorded in Deed Book
1026, Page 565 in the office of the County Court Clerk of McCracken County
KY; thence with the west property line of the above referenced Howland tract
South 22°17'26" West, a distance of 142.39 feet to an iron pin and cap stamped
TLS/SEI KY LS 3559, said iron pin is the southwest property corner of the above
referenced Howland tract; thence with the south property line of the above
referenced Howland tract South 67°42'34" East, a distance of 208.71 feet to an
iron pin and cap stamped TLS/SEI KY LS 3559, said iron pin being the southeast
property corner of the above referenced Howland tract; thence with the east
property line of the above referenced Howland tract North 22°17'26" East, a
distance of 43.74 feet to a point; thence with a new line South 38°43'54" East, a
distance of 367.08 feet to a point; thence South 36°26'41" East, a distance of
375.90 feet to a point; thence in a southeasterly direction along an arc turning to l
the right, an arc distance of 203.55 feet, said arc having a radius of 548.22 feet,
and said arc being subtended by a chord bearing South 28°05'43" East, a chord
distance of 202.38 feet to a point, said point being on the south property line of
the above referenced Gordon Farms, Inc. property as recorded in Deed Book 853,
Page 572 (Tract No. 3, Parcel B) in the office of the County Court Clerk of
McCracken County KY; thence continuing with the referenced south property
line North 68°37'28" West, a distance of 1604.52 feet to an iron pin and cap
stamped FH&T 1842 on the east Right of Way of a five foot wide dedicated
Utility tract, said Utility tract being adjacent to the east line of a 50 foot wide
Right of Way of KY Highway 724; thence along the east Right of Way line of
the dedicated Utility tract North 22°28'09" East, a distance of 838.89 feet to the
point of beginning, containing 17.857 acres. All bearings are based on KY State
Plain South, Grid North.
Boundary Description For A 15 -Foot Wide Utility Easement Lying
Adjacent To And East Of The Above Referenced 0.421 Acre Tract Of
Land
Beginning at a point, said point being the northwest corner of the above
referenced 15 -foot wide utility easement, said point being South 68°38'21" East,
a distance of 20.47 feet from an iron pin and cap stamped FH&T 1842, said iron
pin being 30 feet measured perpendicularly from a point in the centerline of KY
Highway 724 (Fisher Road), said iron pin also being the northwest corner of the
above referenced property of Gordon Farms, Inc., said point of beginning being
on the north property line of the above referenced property of Gordon Farms,
Inc.; thence from the point of beginning with the north property line South
68°38'21" East, a distance of 15.00 feet to a point; thence with a new line in a
southwesterly direction along an arc turning to the left, an arc distance of 354.23

22°28'09 West 30 feet east and parallel with the centerline of Ky Hwy 724, a
distance of 445.21 feet from an iron pin and cap stamped FH&T 1842 said iron
pin being the northwest corner of the above referenced Gordon Farms, Inc.
property, said iron pin being 30 feet measured perpendicularly from a point in the
centerline of KY Highway 724 (Fisher Road); thence from the point of beginning

referenced 15 -foot wide utility easement, said point being in the east line of a one
acre tract of land known as the Howland tract owned by the City of Paducah and
the County of McCracken, Kentucky as recorded in Deed Book 1026, Page 565
in the office of the County Court Clerk of McCracken County KY, said point
being North 22°17'26" East as measured along the east property line of the
Howland tract, a distance of 43.74 feet from an iron pin and cap stamped
TLS/SEI KY LS 3559; thence from the point of beginning and continuing along
the east property line of the Howland tract North 22 17'26" East, a distance of
17.15 feet to a point; thence with a new line South 38°43'54" East, a distance of
375.69 feet to a point; thence South 36°26'41" East, a distance of 375.90 feet to a
point; thence in a southeasterly direction along an arc turning to the right, an arc
distance of 220.78 feet, said arc having a radius of 563.22 feet, and said arc being
subtended by a chord bearing South 27°28'27" East, a chord distance of 219.37
feet to a point on the south property line of the above referenced Gordon Farms,
Inc. property; thence with the south property line of the Gordon Farms, Inc.
property North 68°37'28" West, a distance of 19.09 feet to a point; thence with a
new line in a northwesterly direction along an arc turning to the left, an arc
distance of 203.55 feet, said arc having a radius of 548.22 feet, said arc being

subtended by a chord bearing North 28°05'43" West, a chord distance of 202.38
feet to a point; thence North 36°26'41" West, a distance of 375.90 feet to a point;
thence North 38°43'54" West, a distance of 367.08 feet to the point of beginning,
containing 0.33 acres. All bearings are based on KY State Plain South, Grid
North.
SECTION 4. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.
