ORDINANCE NO. 2004-2-6763
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER
INTO AN ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH
AND PRECISION MACHINE, INC., FOR AN ENCROACHMENT UPON A
PORTION OF CITY OF PADUCAH RIGHT-OF-WAY OF SOUTH 4TH STREET
WHEREAS, Precision Machine, Inc., is the owner of property located at
1231 South 3rd Street, situated in McCracken County, Paducah, Kentucky; and
WHEREAS, the City of Paducah is the owner of a portion of South 4th
Street located adjacent to Precision Machine, Inc's., property, situated in McCracken
County, Paducah, Kentucky; and
WHEREAS, Precision Machine, Inc., is desirous of encroaching upon and
utilizing a portion of the right of way of South 4th Street to construct a chain link fence;
and
WHEREAS, the City is desirous of permitting the aforesaid encroachment
by Grantee; and
WHEREAS, the City of Paducah and Precision Machine, Inc., have now
entered into an agreement pertaining to the foregoing and do desire that same be set forth
in writing and be made part of the public records of the City of Paducah, Kentucky, and
recorded in the office of the County Court Clerk of McCracken County, Kentucky.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized to enter into an
Encroachment Agreement with Precision Machine, Inc., for a chain link fence to be
located upon a portion of City of Paducah right-of-way of South 4th Street. Said
encroachment area shall be approximately 11' x 700'.
SECTION 2. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRIS Chapter 424.
