AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH AND PADUCAH
TRANSIT AUTHORITY, FOR ENCROACHMENT AND UTILIZATION UPON A PORTION OF
CITY OF PADUCAH PROPERTY
.� WHEREAS, Paducah Transit Authority is the owner of property located at 850 Harrison
Street, Paducah, Kentucky; and
WHEREAS, the City of Paducah is the owner of the 66' right of way known as Harrison
Street which is located adjacent to 850 Harrison Street, being situated in Paducah, Kentucky; and
WHEREAS, Paducah Transit Authority is desirous of encroaching upon and utilizing a
portion of the right of way of Harrison Street to construct a Bus Loading Canopy Structure; and
WHEREAS, the City and Paducah Transit Authority have now entered into an agreement
pertaining to the foregoing and do desire that same be set forth in writing and be made part of the public
records of the City of Paducah, Kentucky, and recorded in the office of the County Court Clerk of
McCracken County, Kentucky.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby approves the Encroachment Agreement
with Paducah Transit Authority for encroaching upon and utilizing a portion of the right of way of
Harrison Street to install a Bus Loading Steel Canopy Structure located to 850 Harrison Street, Paducah,
Kentucky. Said `Encroachment Area" shall be approximately 14' W x 180' L.
SECTION 2. That the Mayor is hereby authorized to execute the Encroachment
Agreement with Paducah Transit Authority, as approved in Section 1 above.
SECTION 3. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
