A MUNICIPAL ORDER AUTHORIZING THE MAYOR TO
EXECUTE A LETTER OF INTENT TO THE U.S. ARMY CORPS OF ENGINEERS
SUPPORTING THE OHIO RIVER SHORELINE, PADUCAH KENTUCKY LFPP
RECONSTRUCTION PROJECT FEASIBILITY REPORT; PLEDGING THE CITY'S
COOPERATION WITH THE OHIO RIVER SHORELINE, PADUCAH, KENTUCKY
RECONSTRUCTION PROJECT AND OFFERING THE CITY'S ASSISTANCE IN
THE INITIATION OF THE PRECONSTRUCTION ENGINEERING AND DESIGN
ACTIVITIES ASSOCIATED WITH THE RECONSTRUCTION PROJECT
WHEREAS, in 1998, the U.S. Army Corps of Engineers (USACE)
completed an Ohio Shoreline Study, 905(b), which noted deterioration conditions of the
Paducah Levee System and recommended reconstruction of major project features; and
WHEREAS, in January 2009, the City and the USACE entered into a
Feasibility Cost Sharing Study Agreement to investigate the rehabilitation of the City's
floodwall, evaluate current and anticipated problems and needs, identify effective and
feasible rehabilitation recommendations and analyze economic, environmental and
engineering impacts; and
WHEREAS, in October 2010, the USACE issued a Draft Feasibility
Report, aka the Ohio River Shoreline, Paducah Kentucky LFPP Reconstruction Project
Feasibility Report, which recommended certain rehabilitation projects to improve the
reliability and restore system performance of the City's 60 year old Floodwall; and
WHEREAS, Major General Merdith W. B. Temple, of the U.S. Army,
signed a letter recommending to the U.S. Congress the implementation of Paducah's
reconstruction projects noted in the Feasibility Report; and
WHEREAS, due to the Major's recommendation, the USACE is ready to
partner with the City and initiate Preconstruction Engineering and Design (PED) and
prepare plans and specifications for the reconstruction projects as listed within the
Feasibility Report; and
WHEREAS, in order to proceed with the recommendations of the Major
General's endorsement letter and to allow the USACE to begin the PED process, the City
will need to execute a Letter of Intent (LOI) supporting the Feasibility Report and the
Ohio River Shoreline, Paducah, Kentucky Reconstruction Project as listed within the
report and offer the City's assistance in the development of the various construction
documents associated with the PED.
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The City of Paducah hereby authorizes the Mayor to
execute a Letter of Intent to the U.S. Army Corps of Engineers supporting the Ohio River
Shoreline, Paducah, Kentucky LFPP Reconstruction Project Feasibility Report which
pledges its City's cooperation with the Ohio River Shoreline, Paducah, Kentucky
Reconstruction Project and offers the City's assistance in the initiation of the
Preconstruction Engineering and Design activities associated with the Reconstruction
Project.
SECTION 2. This Order shall be in full force and effect from and after
the date of its adoption.
