HomeMy WebLinkAbout2005-8-7005467 ORDINANCE NO. 2005-8-7005 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF HARPER INDUSTRIES, CITY OF PADUCAH, MIDWEST TERMINAL INC, AND PADUCAH-McCRACKEN COUNTY CONVENTION CENTER CORPORATION FOR PROPERTY LOCATED ADJACENT TO CAMPBELL STREET AND THE CITY OF PADUCAH FLOODWALL, AND ACCEPTING DEDICATION OF PUBLIC RIGHT OF WAY AND PUBLIC EASEMENTS WHEREAS, by Resolution dated August 1, 2005, the Paducah Planning Commission, adopted a plat of the proposed subdivision of property of Harper Industries, City of Paducah, Midwest Terminal Inc., and Paducah -McCracken County Convention Center Corp., located adjacent to Campbell Street and the City of Paducah Floodwall, and recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and accepting the dedication of public right of way, private and public easements shown thereon; and WHEREAS, the City of Paducah will improve the public right-of-way, therefore, no security is required and said right-of-way will be completed in accordance with the subdivision plan and the City's specifications and the City Engineer hereby recommends the acceptance of the aforesaid subdivision plat. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on August 1, 2005, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF HARPER INDUSTRIES/CITY OF PADUCAH FOR PROPERTY LOCATED ADJACENT TO CAMPBELL STREET AND THE CITY OF PADUCAH FLOODWALL', be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled, "Campbell Street Right of Way Dedication", and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public right-of-way and public easements shown on said plat shall be, and they are hereby, accepted and shall be maintained by the City of C1 Paducah. The Mayor is hereby authorized to subscribe a certificate of approval on the plat. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. mfbmm.u_b[,u itlreeYtltltll- ._ ._ _� 468 SECTION 5.
