HomeMy WebLinkAbout2005-6-6984ORDINANCE NO. 2005-6-6984 AN ORDINANCE AMENDING CHAPTER 122, VEHICLES FOR HIRE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Sec. 122-79, "Permit," of Chapter 122, Vehicles for Hire, of the Code of Ordinances of the City of Paducah, Kentucky, is hereby amended to read as follows: "Sec. 122-79. Permit. (a) The city manager shall conduct an open bidding to award a Downtown Horse Carriage Tour Permit for the sole right to operate a horse drawn carriage business within the downtown area defined by the City Manager and for the sole right to use the carriage corner at Second and Broadway as a passenger pick up and discharge site for a period of three (3) years (1) The winning bidder will be chosen according to the following criteria: a. Display willingness and ability to comply with all parts of this ordinance b. Possess experience that is necessary to proper horsemanship and the safe operation of a horse carriage in large crowds of people as well as heavy automobile traffic c. Demonstrate the ability to provide adequate service to meet customer demands by operating such carriages every Friday and Saturday night from April through October including special events and festivals which may occur during this time, *p weather permitting. d. Present description of different types of tours offered, and the rates to be charged for each type of tour. (b) A separate Contract Carriage Operating Permit will be issued on a temporary basis to operators who have been hired for a specific event (party, wedding, etc.). Such permit shall be issued up to fifteen (15) city business days before such business conducted by the operator shall take place. (1) This permit is valid for only as long as the specified permitted event is occurring (2) An applicant for this permit shall also comply with all part of Section C listed below during each year in which they apply for this license (3) Applicants must fax or otherwise provide to the City, no later than one (1) full business day prior to the event, a map showing: a. Point of origin b. All roads being traveled before, during, and after the contracted carriage services are performed c. Final destination �!✓ (4) An applicant for this permit is prohibited from picking up or transporting passengers who are not associated with the party contracting for service, or traveling on roads not approved in his Contract Carriage Operating Permit. (5) Applicant must comply with all other parts of this ordinance (6) This permit is open to any operator, provided they comply with all parts of Section C below, including operators who have been awarded a Downtown Horse Carriage Tour Permit 437 (c) Carriage service providers shall also provide the following a. Adequate identification of the applicant and animal -drawn vehicle and proof of ownership b. Material setting forth characteristics of the vehicle, including its dimensions, and estimated passenger capacity. c. Color photographs not less than five inches by seven inches of the vehicle or sketches of a similar make and model of the vehicle d. Adequate proof of Liability Insurance in the form of Certificate of Liability, the City of Paducah requires minimum limits of Public Liability of $1.000.000.0o (one million dollars) combined single limit Bodily Injury and PrODpIly Damage per occurrence i ii. The City of Paducah shall be named as an additional insured; e. Satisfactory proof of health inspections of the animal(s) to be utilized in drawing the vehicle f. A permit fee, in addition to the business license fee. i. $25.00 per year for Downtown Horse Carriage Tour Permit ii. $5.00 per occasion for Contract Carriage Operating Permit, not to exceed a total of $25.00 per year. g. A current city business license h. Evidence of satisfactory annual safety and appearance inspection of tack and equipment, including devices that prevent droppings from being left on city streets; and i. Evidence of compliance with all the standards for vehicles in this article (d) Inspection for compliance shall be performed by the Director of Animal Control, his departmental designee, or other such individual as designated by the City Manager. In the event of compliance, the inspector shall certify such compliance to the city Finance Director, who shall then issue a permit upon payment of the fee." SECTION 4. That if any section, paragraph or provision of this Ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this Ordinance to make each and every section, paragraph, an provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: Tammara S.
