ORDINANCE NO. 2006-12-7215
AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH
PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTY LOCATED AT
127 BIRCH STREET, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO
EFFECT SUCH REZONING
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution passed by the Paducah Planning Commission on
December 4, 2006, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE
PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FOR .7598
ACRES OF PROPERTY LOCATED AT 127 BIRCH STREET," be approved as the final report of said
Commission respecting the matters therein set forth.
SECTION 2. That the zone classification and the map amendment proposed in said
resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the
City of Paducah.
SECTION 3. That the zone classification of 127 Birch Street, and it is hereby, changed
from R-1 (Low Density Residential Zone), to B-1 (Convenience & Service Zone):
A certain tract of land to be zoned "B1" (Convenience & Service Zone) from "R-2" (Low &
Medium Density Residential Zone) as surveyed by Ricky A. Tosh, PLS No. 2900 of the
firm of Dummer Surveying & Engineering Services, Inc. of Paducah, Kentucky on October
18, 2006, located north of U.S. Highway 45 (Lone Oak Road) and on the west side of
Birch Street and the south side of Sanders Avenue (undeveloped) in Paducah,
McCracken County, Kentucky, and being more particularly described as follows;
Beginning at the centerline intersection of Birch Street and Sanders Avenue;
THENCE from the POINT OF BEGINNING South 33 degrees 26 minutes 31 seconds
East for a distance of 180.00 feet with the centerline of Birch Street to a point at the
centerline intersection of Birch Street and a alley;
THENCE South 56 degrees 33 minutes 29 seconds West for a distance of 202.69 feet
with the centerline of the alley to a point in the west line of the L. D. Sander's Arcadia
Subdivision;
THENCE North 21 degrees 37 minutes 57 seconds West for a distance of 183.89 feet
with the west line of said subdivision to a point in the centerline of Sanders Avenue
(undeveloped);
THENCE North 56 degrees 33 minutes 29 seconds East for a distance of 165.06 feet with
the centerline of Sanders Avenue to the POINT OF BEGINNING;
Together with and subject to covenants, easements, right-of-ways and restrictions of
record and in existence.
Said property contains 0.7598 acres.
SECTION 4. That if any section, paragraph or provision of this ordinance shall be found
to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section,
paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the
purpose and intent of this ordinance to make each and every section, paragraph and provision hereof
separable from all other sections, paragraphs and provisions.

SECTION 5. Pursuant to KRS 83A.060, the City Commission suspends the
requirement of a second reading and publication of this Ordinance. As grounds therefore, the
City Commission does hereby declare an emergency to exist due to a delay of the public hearing
with the City of Paducah Planning Commission and the property owners needing to expedite a
closing date.
SECTION 6. This Ordinance shall become effective upon the first reading of this
Ordinance.
