ORDINANCE NO. 2006- 8-7161
AN ORDINANCE CREATING ARTICLE V OF CHAPTER 70 OF THE CITY
OF PADUCAH CODE OF ORDINANCES AND THEREBY ESTABLISHING
THE PADUCAH SKATEPARK AND RULES AND REGULATIONS FOR
SAME.
WHEREAS, the City of Paducah, Kentucky (the "City") has determined that it is in the
best interest of the citizens of Paducah to establish a skatepark to be located within Bob Noble
Park and to make it available to the public for recreational purposes; and
WHEREAS, this ordinance is enacted and the skatepark is created in compliance with the
Kentucky Recreational Use Statute; and
WHEREAS, the City wishes to establish rules and regulations pertaining to the skatepark
in order to protect the City from liability for injuries that may occur at the park and in order to
establish rules for skatepark users and the care of the facility.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF
THE CITY OF PADUCAH, KENTUCKY, AS FOLLOWS:
Section 1. Established. There is hereby created "The Paducah Skatepark" which is
located within Bob Noble Park, both of which are owned by the City of Paducah.
Section 2. Definitions.
a. Roller skate. Roller skate means a tandem or inline set of wheels mounted on a
frame that can be fitted to the sole of a shoe or a shoe mounted on a tandem or inline set of
wheels.
b. Skateboard. Skateboard means a tandem or in-line set of wheels mounted on a
1 board or frame with or without a steering handle which is not propelled by a motor.
C. The Paducah Skate ark. The Paducah Skatepark is a public facility owned by the
City of Paducah for recreational use by persons riding skateboards, roller skates, and bicycles.
d. Users. Any person or persons directly or indirectly invited or permitted to use
the Paducah Skatepark for their recreational purposes.
Section 3. Charges and Fees Prohibited. The Paducah Skatepark is open to any person
or persons so they may use the property for recreational purposes without charge. Fees and
charges for use of the skatepark are prohibited.
Section 4. Rules and Regulations. The following rules and regulations are to be made
known to users of The Paducah Skatepark.
1.
WARNING. The Paducah Skatepark is unsupervised. Users assume all risks
inherent in the use of this facility. Use may result in serious injury up to and
including death.
2.
Know your abilities and skate at your own risk.
3.
Minors should have parental supervision.
4.
Only skateboards, roller skates, and bicycles are allowed in the skate area.
5.
No motorized devices of any sort are allowed within The Paducah Skatepark.
6.
Users shall wear a protective helmet (by ordinance). Elbow, knee, and wrist pads

are strongly encouraged.
7.
Do not engage in reckless behavior (including, but not limited to, tandem riding,
pushing, horseplay, fighting, and/or bullying), or any other activity that could
endanger the safety of others.
8.
No smoking, eating or drinking allowed within the fenced area.
9.
No glass containers in the fenced area.
10.
No alcohol or drugs permitted.
11.
No firearms, knives or other weapons allowed.
12.
No items may be brought into the fenced area as obstacles, ramps or for any other
purpose.
13.
Do not proceed into the skate area until it is clear of other users and/or any
debris.
14.
Do not overcrowd the facility.

15. Do not use the facility during or after bad weather. Certain weather conditions
such as rain, snow or ice can adversely affect ramps and surface conditions.
16. No spectators inside the skating area.

18. No pets are allowed inside the fenced area.
19. The Kentucky Recreational Use Statute (KRS 411.190) applies to The Paducah
Skatepark.
Section 5. Rules and Regulations Posting. The rules and regulations pertaining to The
Paducah Skatepark shall be posted at the entrance to The Paducah Skatepark. They should
clearly summarize the rules and regulations set forth in Section 4, along with any other rules and
regulations that the Director of Parks Services deems necessary.

established by the Parks Services Director.
Section 7. Helmet. No person while on the premises of The Paducah Skatepark shall
ride, propel, or any in manner operate a skateboard, roller skates, and/or a bicycle unless he or she
is wearing a protective helmet at all times when the skateboard, roller skates, or bicycle is in
motion. The helmet should be designed for use with a skateboard, roller skates, and/or bicycle
and should be in good repair at all times during use.
Section 8. Age Restriction. There shall be no age restrictions at The Paducah
Skatepark. However, The Paducah Skatepark is unstaffed and users use The Paducah Skatepark
at their own risk. Accordingly, parents are strongly encouraged to supervise their minor children
to ensure their safety.
Section 9. Motorized Devices Prohibited. No motorized device shall be used within
the area of The Paducah Skatepark.
Section 10. Skate at Your Own Risk. The City of Paducah hereby expressly hereby
adopts a "Skate at Your Own Risk" policy. (D
Section 11. Kentucky Recreational Use Statute. The City of Paducah invites and
permits without charge any person to use The Paducah Skatepark for their recreational purposes
in compliance with the Kentucky Recreational Use Statute (KRS 411.190).
Section 12. Severability. If any provision of this Article is now or later amended or its
application to any person or circumstances held to be invalid, the invalidity does not effect other
provisions that can be given effect without the invalid provision or application.
Section 13. Penalties. Whoever violates any provision of this Article for which no
penalty is otherwise provided shall be guilty of a misdemeanor and shall be fined up to Fifty
Dollars ($50.00) for a first offense, up to One Hundred Dollars ($100.00) for a second offense,
and up to but not more than Five Hundred Dollars ($500.00) for each and every offense or
violation committed thereafter.
Section 14. Effective Date. This Ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.
