ORDINANCE NO. 2007-12-7374
AN ORDINANCE RESCINDING THE ACCEPTANCE OF THE BID OF
BOULDIN ROOFING COMPANY FOR REPLACEMENT OF THE ROOF ON FIRE
STATION #5 AND RATIFYING AND APPROVING THE CANCELLATION OF
1NVITIATIONS FOR BIDS AND/OR REJECTION OF ALL BIDS IN THAT SUCH ACTION
IS IN THE BEST INTEREST OF THE CITY
WHEREAS, the City of Paducah previously requested bids for the replacement of
the roof on Fire Station #5; and
WHEREAS, the City of Paducah had previously adopted Ordinance No. 2006-10-
7189, accepting the bid of Bouldin Roofing Company for such replacement and authorizing the
Mayor to execute a contract pursuant to the specifications contained in the invitation for bids;
and
WHEREAS, prior to the execution of the aforesaid contract and pursuant to KRS
45A.390 and Sections 2-650(e), 2-651, and 2-645(g) of the Paducah Code of Ordinances, the
City Manager, with the recommendation of the appropriate department head, rescinded the
invitation for bids and/or rejected all bids due to a change in conditions making it necessary to
modify the terms of the invitation for bids and requiring major revisions in the specifications, and
his determination that such action was in the best interest of the City.
C, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH,KENTUCKY:
SECTION 1. Recitals and Authorization The Board of Commissioners of the
City of Paducah hereby rescinds Ordinance 2006-10-7189, adopted on October 10, 2006, which
accepted the bid of Bouldin Roofing Company for replacement of the roof on Fire Station #5,
and authorized the Mayor to execute a contract pursuant to the specifications contained in the
invitation for bids.
SECTION 2. Recitals and Authorization The Board of Commissioners of the
City of Paducah, Kentucky, hereby ratify and approve the action taken by the City Manager, with
the recommendation of the appropriate department head, rescinding the invitation for bids and/or
rejecting all bids due to a change in conditions making it necessary to modify the terms of the
invitation for bids and requiring major revisions in the specifications and his determination that
such action is in the best interest of the City.
SECTION 3. Severability. If any section, paragraph or provision of this
cl�Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or
unenforceability of such section, paragraph or provision shall not affect any of the remaining
provisions of this Ordinance.
SECTION 4. Compliance With Open Meetings Laws. The City Commission
hereby finds and determines that all formal actions relative to the adoption of this Ordinance
were taken in an open meeting of this City Commission, and that all deliberations of this City

Commission and of its committees, if any, which resulted in formal action, were in meetings
open to the public, in full compliance with applicable legal requirements.
SECTION 5. Conflicts. All ordinances, resolutions, orders or parts thereof in
conflict with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed
and the provisions of this Ordinance shall prevail and be given effect.
SECTION 6. Effective Date. This Ordinance shall be read on two separate days
and will become effective upon summary publication pursuant to KRS Chapter 424.
