AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE AN AGREEMENT FOR OPERATION OF THE GOVERNMENT ACCESS
CHANNEL 11 AND OTHER RELATED SERVICES
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized and directed to execute an
agreement between City of Paducah, Paducah Cable Authority, West Kentucky Community &
Technical College and Paducah Junior College for operation of the Government Channel 11 and
related services for the City in the amount of $70,000. This Agreement will expire June 30,
2008.
SECTION 2. Payment for these services will be as follows:
a) The City will fund to the Paducah Junior College $70,000 from the City's
FY2008 Budget. The City shall appropriate and remit funds to the
Paducah Junior College by December 31St of each year upon receipt of
invoice.
b) In addition, the City will pay on a quarterly basis to the Paducah Junior
College proceeds from the PEG Access Capital Fee. Section 13 of the
Franchise Agreement, adopted by Ordinance No. 2006-10-7184, states
"the Franchisee shall collect on behalf of the City a per subscriber fee of
twenty-five cents ($0.25) per month solely to fund PEG access capital
expenditures (PEG Access Capital Fee)." The City will remit the Paducah
Junior College's portion, as set by the Authority, of the Franchisee's
quarterly PEG Access Capital Fee.
c) Failure of any party to fulfill this responsibility can constitute notice of
termination.
SECTION 3. This expenditure shall be funded through accounts: Cable
Authority Other and PEG Payments.
SECTION 4. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424_
