ORDINANCE NO. 2007-5-7280
AN ORDINANCE AUTHORIZING AND APPROVING PURCHASE OF REAL
PROPERTY LOCATED AT 1851 NORTH EIGHTH STREET, PADUCAH, McCRACKEN
COUNTY, KENTUCKY, FOR AND IN CONSIDERATION OF
$70,000.00, BY THE CITY OF PADUCAH, KENTUCKY, FOR THE USE AND BENEFIT OF
THE COMMISSIONERS OF THE PADUCAH WATER WORKS.
WHEREAS, the Commissioners of the Paducah Water Works has determined that
it is necessary, appropriate, or in the best interest of the operations of the Paducah Water Works
that the real property located at 1851 North Eighth Street, Paducah, McCracken County,
Kentucky, which is more particularly described on Exhibit "A," attached hereto (the
"Property"), be purchase for purposes of future planning and system expansion, all as reflected in
a resolution passed by the Commissioners of the Paducah Water Works on April 25, 2007; and
WHEREAS, the Commissioners of the Paducah Water Works has entered into an
agreement for the purchase of the Property with Pumping Partners, LLC, a Delaware limited
liability company, for the purchase price of Seventy Thousand Dollars ($70,000.00); and
WHEREAS, the Board of Commissioners of the City of Paducah concurs with the
Commissioners of Paducah Water Works and finds that the purchase of the Property for the price
of Seventy Thousand Dollars ($70,000.00) is in the best interest of the City and the Paducah
Water Works.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. Recitals and Authorizations. The City of Paducah hereby formally
approves of and the Mayor of the City of Paducah, Kentucky, is hereby authorized to purchase the
Property from Pumping Partners, LLC, a Delaware limited liability company, for and in consideration of
Seventy Thousand Dollars ($70,000.00) in accordance with the terms of the agreement previously
entered into between the Commissioners of the Paducah Water Works and the Pumping Partners, LLC.
SECTION 2. Recitals and Authorizations. That the Mayor of the City of
Paducah, Kentucky, is hereby authorized to enter into and execute any and all documentation
necessary to effectuate the purchase of the Property.
SECTION 3. Funding of the Purchase Price. All monies necessary for the purchase of
the Property, including without limitation, the purchase price to be paid, shall be funded by the
Commissioners of the Water Works and shall be received and paid by the City for the benefit of the
\_ Commissioners of the Paducah Water Works.
SECTION 4. Severability. If any section, paragraph or provision of this Ordinance shall
be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section,
paragraph or provision shall not affect any of the remaining provisions of this Ordinance.
SECTION 5. Compliance With Open Meetings. The City Commission hereby

finds and determines that all formal actions relative to the adoption of this Ordinance were taken in an
open meeting of the City Commission, and that all deliberations of this City Commission and of its
committees, if any, which resulted in formal action, were in meetings open to the public, in full
compliance with applicable legal requirements.
SECTION 6. Conflicts. All ordinances, resolutions, orders or parts thereof in conflict
with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed and the
provisions of this Ordinance shall prevail and be given effect.
SECTION 7. Effective Date. This Ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.

LEGAL DESCRIPTION OF THE PROPERTY
Beginning at an iron stake on the north side of North Eighth
Street, said stake is located 510 feet west from the
southwest corner of the tract of land conveyed to Mrs.
Pauline Magee by Fletcher Terrell and marks the southwest
corner of Herbert Riley's west line North 8 degrees East 256
l feet to an iron stake in S.W. Watson's south line; thence
with S.W. Watson's line North 81 degrees West 150 feet to a
stake in said line; thence South 8 degrees West 256 feet to
an iron stake in the north line of North Eighth Street;
thence with the north line of North Eighth Street South 81
degrees East 150 feet to the point of beginning.

Being the same property conveyed to Pumping Partners, LLC by
deed dated June 18, 1998, and recorded in Deed Book 897,
page 115, in the McCracken County Court Clerk's Office.
