ORDINANCE NO. 2012-7-7937
AN ORDINANCE AUTHORIZING SALE OF MUNICIPALLY
OWNED REAL PROPERTY HELD FOR THE USE AND BENEFIT
OF THE COMMISSIONERS OF WATERWORKS OF THE CITY
OF PADUCAH, DBA PADUCAH WATER
WHEREAS, the City of Paducah ("City") owns certain real property located at the corner
of Old Calvert City Road and Kentucky Dam Road (U. S. Hwy 62) which property was originally
acquired by the Reidland Water District and by virtue of acquisition is now owned by the City for
the use and benefit of the Commissioners of WaterWorks of the City of Paducah, DBA Paducah
Water ("Paducah Water"); and
WHEREAS, the subject property is located in McCracken County, Kentucky and is more
particularly described in the attached Exhibit "A," (the "Property"); and
WHEREAS, Paducah Water has determined that the Property is no longer necessary,
appropriate, or in the best interests of the operations of the water works and that the Property
should be sold as surplus real estate, all as reflected in a resolution passed by Paducah Water on
May 30, 2012; and
WHEREAS, Paducah Water desires that the Property be offered for sale as surplus
property in accordance with KRS 82.083 and the sealed bidding procedure set forth in the City of
Paducah Codes of Ordinance Section 2-668; and
NOW, THEREFORE, BE IT ORDERED BY THE BOARD OF COMMISSIONERS OF
THE CITY OF PADUCAH, KENTUCKY:
Section 1. Recitals and Authorizations. The Board of Commissioners hereby declares
the Property to be surplus property as it relates to the operations of Paducah Water.
Section 2. Recitals and Authorizations. The Board of Commissioners further declares
that the sale of the surplus property be handled by Paducah Water in accordance with the
requirements of KRS 82.083 and the sealed bidding procedure set forth in the City of Paducah
Codes of Ordinance Section 2-668.
Section 3. Recitals and Authorizations. That the Mayor of the City of Paducah,
Kentucky, for the benefit and use of the Commissioners of Waterworks of the City of Paducah,
be and he is hereby authorized to execute and deliver a deed of conveyance of the Property to the

high bidder upon acceptance of the bid, together with all other documentation necessary to
effectuate the transfer of the Property.
Section 4. Distribution of Proceeds. The monies due to Paducah Water for the sale of the
surplus property shall be remitted to Paducah Water following execution and delivery of the
aforesaid deed of conveyance.
Section 5. Severability. If any section, paragraph or provision of this Order shall be held
to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section,
paragraph or provision shall not affect any of the remaining provisions of this Order.
Section 6. Compliance with Open Meetings Laws. The City Commission hereby finds
and determines that all formal actions relative to the adoption of this Order were taken in an open
meeting of the City Commission, and that all deliberations of this City Commission and of its
committees, if any, which resulted in formal action, were in meetings open to the public, in full
compliance with applicable legal requirements.
Section 7. Conflicts. All ordinances, resolutions, orders or parts thereof in conflict with
the provisions of this Order are, to the extent of such conflict, hereby repealed and the provisions
of this Order shall prevail and be given effect.
Section 8. Effective Date. This ordinance shall be read on two separate days and
will become effective upon summary publication pursuant tojKRS Chapter 424.

EXHIBIT "A" to Ordinance No. 2012-7-7937
Beginning at a point in the Southerly right of way line of U. S. Highway 62, said beginning point
being located in an Easterly direction and 282.8 feet from the southeast intersection of the
property line of Barton Circle and the Southerly right of way line of U. S. Highway 62; thence in
a Southerly direction and along the Easterly tract line of the Fisher Subdivision as shown in Plat
Book "G", page 235 for a distance of 206.32 feet to a point in the Northerly right of way line of
the Old Calvert City Road; thence with an interior angle of 57 deg 55' and in an Easterly
_ direction and along the Northerly right of way line of the Old Calvert City Road 137.2 feet to a
point; thence with an interior angle of 122 deg 40' and in a Northerly direction 67.3 feet to a
point in the Southerly right of way line of U. S. Highway 62; thence with an interior angle of 119
deg 05' and in a Westerly direction and along the Southerly right of way line of U. S. Highway
62 for a distance of 134.5 feet to the point of beginning. (The first call and last call in the above
description make an interior angle of 60 deg 20').
Being the same property conveyed to Reidland Water District by deed dated April 4, 1973, of
record in Deed Book 551, page 489, McCracken County Court Clerk's Office.
