HomeMy WebLinkAboutMO # 2080MUNICIPAL ORDER NO. 2080 A MUNICIPAL ORDER ACCEPTING THE BID FOR THE CITY OF PADUCAH' S CALENDAR YEARS 2018 AND 2019 CONCRETE PROGRAM, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The Mayor is hereby authorized to execute a contract with Harper Construction, LLC, for concrete work at the unit prices and hourly rates as accepted in Section 1 above, according to the specifications, bid proposal and contract documents heretofore approved and incorporated in the bid of February 13, 2018. SECTION 3. The contract shall be binding upon the City and the Contractor, his partners, successors, assigns and legal representatives for 2018-2019 calendar years ending December 31, 2019. Neither the City nor the Contractor shall have the right to assign, transfer, or sublet their interests or obligations hereunder without consent of the other party. Further, the Mayor is hereby authorized, subsequent to the recommendation of the City Engineer -Public Works Director, to execute an additional One -Year Renewal Agreement extending the contract period for the 2020 calendar year ending December 31, 2020 upon the mutual agreement of both parties. If agreed, this renewal option shall be exercised by both parties executing and delivering the written One -Year Renewal Agreement. The City reserves the right to have concrete work completed at the quoted prices until the parties have executed the One -Year Renewal Agreement. However, in no case shall the Seller be bound to sell the contract material at these prices past December 31, 2019. SECTION 4. Expenditures for the City's concrete program shall be charged to various accounts. SECTION 5.
